CALL TO ORDER
City of Lake Oswego
Development Review Commission Minutes
May 17,2010
Chair Alby Heredia called the Development Review Commission meeting of May 17, 201 0, to
order at approximately 6:00p.m. in the Council Workroom of City Hall at 380 "A" Avenue, Lake
Oswego, Oregon.
ROLLCALL
Commissioners present: Chair Alby Heredia, Don Richards, Bob Needham, and Peter Scott.
Vice Chair Gregg B. Creighton, Krystyna Stadnik, and Frank Rossi were not present. Staff
present: Evan Boone, Deputy City Attorney; and Janice Reynolds, Administrative Support.
APPROVAL OF FINDINGS, CONCLUSIONS AND ORDER
LU 09-004.6, a request by the Chris and Jill HaiL ·
Richards moved to approve LU 09-0046-1730, Findings, Conclusion and Order .
Needham seconded the mofion and it passed 4:0.
ADJOURNMENT
There being no further business Chair Heredia adjourned the meeting at 6:01 p.m.

Staff Report·
Ms. Debra Andreades recalled that the prim~ry issue at the previous hearing had -been whether
the house to the south at 425 Furnace Street was less intensive residential use. The intensity of
t_he use related to how many units it had. Based on the testimony and evidence the staff found
that house was at least a duplex. Since the applicants also proposed a duplex, the adjacent
house was not a less intensive use, So the proposed south setback was correct.
Deliberations
Chair Heredia closed the public hearing. He agreed the evidence showed the adjacent house
was at least a duplex and the proposed 1 0-foot setback was appropriate.
Mr. Scott asked how much latitude the Commission had regarding the pathway.
Mr. Boone advised the Commission has no authority to decide on the construction of the
pathway along the river as raised by the neighborhood. He advised the Commission to
determine if there was a requirement for sideWalks (to be installed at some point in the future)
anc:J if the proposed development triggered that requirement.
Mr. Needham agreed the issue before the DRC was whether a sidewalk should be required.
The neighborhood might have valid concerns about the pathway, but they should seek answers
directly from the City on that matter.
Mr. Richards moved to approve LU 09-0046. Mr. Needham seconded the motion and it
passed4:0.
• Heredia announced final vote would be conducted on May 17, 2010 at 6 pm.

GENERAL PLANNING & OTHER BUSINESS
Code Audit
Ms. Andreades reported the City had engaged a consulting firm to look at the structure of the
code. They wanted input from the Planning Commission and Development Review
Commission. The DRC was invited to join the Planning Commission at its June 14th meeting to
help refine the consultants' draft report.
LO 2030 (Comprehensive Plan Update)
Sidaro Sin, Senior Planner, Long Range Planning Division, asked the Commissioners for
their input on the draft Vision statement he had distributed to them. There was a consensus to
suggest that the City Council appoint Needham as bRC liaison to a steering committee if the
City Council chose to form such a committee. Sin assured them there would be a broader
public process. The staff was fashioning it now. The goal was to involve citizens who did not
normally participate in the planning process. The timeline was to refine the draft Vision during
the rest of 2010 so the City Council could adopt it in February 2011. It would be the introduction
to the updated Comprehensive Plan. -

The draft Vision statement indicated that Stafford would be developed thoughtfully, if at all.
Needham anticipated there would be a lot of interest in Stafford. fhe Commissioners wanted to
know how much of it was under City control and what stances other cities around Stafford had
taken. Sin advised that most of it was outside the City's UGB and currently controlled by
Clackamas County. West Linn was contemplating·taking legal action if Metro designated
Stafford as urban reserves. Lake OsWego had no intent to provide services to Stafford.
Tualatin had taken a similar stance. Sid explained the DRC would have additional opportunities
for input throughout the process. ihe next step would be to refine the draft based on i_nput from
City boards and commissions. Sin planned to continue to update the DRC.
