CALL TO ORDER Chair Krystyna Stadnik called the Development Review Cammission(DRC) meeting af February 2, 2009, to order at approximately 7:00 p.m. in the Council Chambers of City Hall at 380 "A"Avenue, Lake Oswego, Oregon. II. ROLL CALL Commissioners present: Chair Stadnilc, Alby Heredia, Bob Needham, Don Richards, Frank Rossi and Peter Scatt. Commissioner Gregg Creighton was absent. Staff present: Hamid Pishvaie, Assistant Planning Director; Leslie Hamilton, Associate Planner; Evan Boone, Deputy City Attorney; and Janice Reynolds, Administrative Support. IIL MINUTES (None) IV. APPROVAL OF FINDINGS, CONCLUSIONS AND 4RDER LU 07-0031 fAP 07-08�, a request by Northwest Housing Alternatives Mr. Heredia moved ta apprave the findings denying the request. Mr. Needham secanded; passed 6-Q. LU 07-0090, a request by Janet Sue La Fontaine Mr. Richards maved to approve the findings. iVlr. Heredia seconded; passed 6-0. Mr. Heredia aslced if the front yard setback reduction for Lots 1 and 2 was reflected in the findings? Mr. Pishvaie replied that to properly address that issue Condition�A(7}(c} should be � revised to read "front yard setback 20 feet on Lots 1 and 2". Mr. Heredia moved to approve LU 07-0090 as amended Mr. Richards seconded; passed 6-0. V. PUBLIC HEARING LU 08-0028, a request by David and Calleen Maslen for approval of the follawing: ■ Resource Protection (RP) District boundary delineation. ■ A setbacic modification pursuant to LOC 50.16,040 to construct additions to the existing dwelling, which is located within the 25' RP buffer on the site: - An 8.5' reduction to the 12.5' front yard setback along Springbrook Court to four feet (measured to the roof eave line; the building wall is setback six feet from the property line). This hearing has been continued from the January 21, 2009, DRC meeting for deliberation purposes only (request to leave written record open for 7 days following first evidentiary hearing; no additional public testimony scheduled). Chair Stadnik opened the deliberation. Each of the Commissioners present declared their business or occupation as follows: Heredia (real estate broker/appraiser); Needham (retired lawyer); Richards (landscape architect/certified arborist); Rossi (architectural drafter and designer); Scott (engineering and design); and Chair Stadnik (civil engineer). No one present challenged any Commissioner's right to hear the application. STAFF REPORT Ms. Hamilton reviewed the additional information received since the January 21 st DRC hearing. There was no rebuttal submitted by the applicant. Mr. Schaeffer waived his right to final written argument. DELIBERATION Mr. Heredia noted the applicants are to be commended for working very hard in addressing any concerns from the neighbors. Mr. Scott added the updated design was much nicer than the original design and it will be a nice addition to the neighborhood. Chair Stadnik agreed the applicants had worked very hard to address concerns from the neighborhood. Mr. Heredia moved to approve LU 08-0028. Mr. Rossi seconded; passed 6-0. Mr. Boone stated the written findings will be adopted on February 18, 2009, at 6 PM. VI. GENERAL PLANNING & OTHER BUSINESS (None) VII. ADJOURNMENT There being no further business Chair Stadnik adjourned the meeting at 7:20 p. in.
