Members present: Vice-Chair David Poulson, Kelly Melendez, Paden Prichard, David Rabbino, Jeff Shearer and Kirk Smith. Chair Brent Ahrend was excused. Staff present: Hamid Pishvaie, Assistant Planning Director; Johanna Hastay, Associate Planner; Evan Boone, Assistant City Attorney; and Barb Dillinger, Administrative Support MINUTES Ms. Melendez moved to approve the Minutes of November 3, 2014. Mr. Prichard seconded and the motion passed 6:0. PUBLIC HEARING LU 14-0073: A request by Our Lady of the Lake Catholic Church for approval of the third and final annual review of the Traffic Monitoring and Maintenance Plan for Our Lady of the Lake Parish (required per LU 09- 0029). Location of Property: 650 A Avenue (Tax Lot 8700 of Tax Map 21 E 03CD and Tax Lots 13500, 13600, & 13700 of Tax Map 21E 03DC). Vice-Chair Poulson opened the hearing. Mr. Boone outlined the scope and applicable procedure. Mr. Poulson reported a site visit and Mr. Shearer related he was a member of the church. No one challenged any Commissioner's right to hear the matter. Staff Report Ms. Hastay presented the January 22, 2015 Staff Report. She discussed why staff found the applicant had complied with Condition G, including the outreach and Evergreen traffic counts components of it which had been modified during the first and second annual reviews. Staff recommended approval. Questions of staff Ms. Hastay clarified in regard to Condition G(2)(c) which allowed a 20% increase in the base count of school-related traffic on Evergreen Road. The base count was based on traffic patterns of the smaller school that existed when the original application was approved. The increase was to account for eventual school expansion to 320 students. Based on the applicant's history of responsiveness to the City and neighbors, staff anticipated the applicant would contact the City when they got close to full capacity, which was when a final review was required. Applicant Katie Atkins, Mackenzie, 1515 SE Water Ave., Ste. 100, Portland, Oregon (97214), represented the applicant. She stated that the applicant's business manager would contact the City when the school reached full occupancy and a final traffic study would be done. They did not yet know when that would happen. During the questioning period, Ms. Atkins confirmed she had conducted the traffic study every year and there was consistency in how they counted cars. City of Lake Oswego Development Review Commission Minutes of February 2, 2015 Page 1 of 2 Public Testimony Proponent Don Graham, Chair of the Evergreen Neighborhood Association, testified the Association supported approval (Exhibit G100). They thought the school had done an exemplary job of managing the traffic plan in the last two years. Deliberations No one requested more time to submit additional written testimony. The applicant waived their right to additional time in which to submit a final written argument. Vice-Chair Poulson opened deliberations. He and Mr. Prichard each noted the letter the applicant sent to parents made it clear they should not use Evergreen. Mr. Poulson recalled staffs report of[improved] traffic counts. Ms. Melendez indicated that her experience on 8th Street during this process was that the traffic had been managed so she supported approval. Mr. Poulson indicated it was good that upon full enrollment the applicant had to report again. Mr. Prichard moved to approve LU 14-0073. Mr. Rabbino seconded and the motion passed 6:0. The final vote on the findings was scheduled for February 8, 2015 at 6:00 p.m. GENERAL PLANNING AND OTHER BUSINESS Staff reported that Councilor Bowerman had been appointed to serve as the new Council liaison to DRC.
