(e-mail via Hageman) • Mark Eves, Lake Oswego Corp. (eveswade@aol.com) • Larry Magura, Tualatin River Rep. (maguralm@bv.com) Staff: • Denny Egner, LO Planning (degner@ci.oswego.or.us) • Susan Millhauser, LO Planning (smillhauser@ci.oswego.or.us) Guests: • Elizabeth Buchanan, Alt. Blue Heron Canal Corp. (mbuchan@celestica.com) • Malcom McIver, Bay Roc Apartments (mmciver@commerceinv.com) Meeting began at 4:10 pm I. Meeting Objectives The main objective of the meeting is continued review of the draft ordinance. II. Draft Ordinance Ordinance Review Frank asked the group to focus on the broad concepts instead of getting slowed down with long discussions over precise wording. He suggested that Work Group members should decide which of the following categories the item being discussed fits into: 1) It gives me heartburn; or 2) I can live with it for now. Members agreed to keep these in mind. Review of the draft ordinance commenced. General concerns about the sections reviewed are included below. Pages 8 & 9 – Section 50.44.022 Flood Management Area – Development Standards Sub-section (2)(h) Utilities. Denny explained how the first three items in this section (i, ii, iii) are related to public services on a parcel, whereas (v) is referring to services within a building, and that these may fit better elsewhere in the ordinance. Minor edits were made to (i, ii, and iii). The Work Group agreed to delete sub-section (iv) as no new on- site waste disposal systems (i.e. septic) would be permitted within the City limits. Discussion about sub-section (v) followed. Mark provided several examples where this standard may prevent typical uses of electricity within the Flood Management Area. For example, he wondered if sub-section (v) would prohibit the use of lawn lights or motors and switches for boat lifts in areas below base flood elevation. Denny noted that the City Floodplain Work Group Page 1 Meeting Notes – September 3, 2002 Building Code requires the placement of wiring and outlets in boat houses, for example, above flood level. The Work Group agreed that since these issues are covered by the Building Code then sub-section (v) could be deleted. Sub-section (2)(i) Manufactured Homes. No changes were proposed. Page 9 – Section 50.44.023 Encroachment within Floodways This section is to be moved before Section 50.44.022. Some minor edits were made to 50.44.023(1). Discussion regarding sub-section (2) followed. Edits were proposed to add greater flexibility in the replacement of a previously existing structure. The Work Group then decided to keep sub-section (2) in its original form and to insert a new sub- section (3) comprised of the edited sub-section (2). Minor edits were made to sub-section (4). Pages 10 & 11 – Section 50.44.025 Standards for Construction Section 50.44.025(1) Certification of Elevation and Flood Proofing. The Work Group was not certain this is the best location for this section. Denny stated he would find a better place for these standards. A sentence was added below the title of the section to clarify that the following standards apply in the Flood Management Area. Several small edits were proposed for (1)(a, b, c). Section (2) Anchoring. Edits were made to distinguish between structures intended to float and other types of structures. Section (3) Construction Materials and Methods. A sentence was inserted at the beginning of this section to clarify that the section applied only to the portion of a building below base flood elevation. Section (4) Building Codes. The Work Group proposed removal of this section as it was extraneous. Page 11 – Section 50.44.030 Standards for Maintenance The Work Group was unclear why this section was here and proposed its deletion. Page 11 – Section 50.44.035 Procedures This section was renamed “Submittal Requirements for Application” to more accurately reflect its contents. A sentence was inserted after the title to clarify that the section applies to the Flood Management Area and that the requirements need only address the portion of a subject property below base flood elevation. Larry and Malcolm suggested that this section would be most useful if it could be used like a checklist. Section (1) Information Required – Habitable Structures. Edits were made to make this section more succinct. In sub-section (1)(b), the phrase “100-year flood plain” was replaced with “base flood” to be consistent with FEMA language. A discussion followed Floodplain Work Group Page 2 Meeting Notes – September 3, 2002 Floodplain Work Group Page 3 Meeting Notes – September 3, 2002 regarding the need for sub-section (1)(c) which requires the location of stream channel banks. The Work Group agreed that the location of stream channel banks was not relevant. As sub-section (1)(e) requires the location of streams, the Work Group agreed to deleted sub-section (1)(c). Sub-section (1)(e) was then edited to only reference streams as the Work Group felt the other referenced items were not pertinent in an ordinance addressing flood management. Sub-section (1)(g) was amended to require only elevations of the lowest floor of proposed structures. Sub-section (1)(h) was deleted as the Work Group felt it was not relevant. Section (2) Information Required – Non-Habitable Structures. Sub-section (2)(b) was edited to reference base flood instead of 100-year floodplain. Sub-section (2)(d) was deleted as the Work Group felt it was not relevant. III. Next Steps Next Meeting: • Thursday September 5, 4 – 6 pm (or later if needed), City Hall Council Chamber. The meeting adjourned at 6:10 p.m. L:\Case Files\2000\LU 00-0024-Floodplain Stds\Work Group\Minutes\09-03-02minutes.doc
