CALL TO ORDER The Development Review Commission meeting of January 3, 2001, was called to order in the Council Chambers of City Hall, at 380 "A" Avenue, Lake Oswego, Oregon, by Chair Douglas P. Cushing at 7:03 PM. II. ROLL CALL Commission members present included Ms. Morales, Mr. Cushing, Ostly and Mr. Powers. Ms. Binkley, Mr. Miller were excused. Staff present were Hamid Pishvaie, Development Review Manager; Evan Boone, Deputy City Attorney and Janice Bader, Senior Secretary. III. APPROVAL OF MINUTES Ms. Ostly moved for approval of the November 20, 2001 minutes as presented. Ms. Morales seconded the motion, and it passed with Mr. Cushing, Ms. Morales, Ms. Ostly and Mr. Powers voting yes. IV. OTHER BUSINESS - Findings, Conclusions and Order LU 00-0072, a request by Steve & Doris Baird Ms. Ostly moved for approval of LU 00-0072 as presented. Ms. Morales seconded the motion and it passed with Ms. Morales, Ms. Ostly and Mr. Powers voting yes. Mr. Cushing abstained. AP 00-19 [LU 00-00101, an appeal by Mark Santos. Mr. Powers moved for approval of AP 00-19 ILU 00-00101 as presented. Ms. Morales seconded the motion and it passed with Ms. Morales, Ms. Ostly and Mr. Powers voting yes. Mr. Cushing abstained. V. PUBLIC HEARING LU 00-0071, a request by Avamere Development for approval of the following: • Construction of a 56 -unit Alzheimer's Senior Care Facility • Establishment of a Protection Area for a Resource Conservation district along the Development Review Commission Minutes Page 1 of 3 January 3, 2001 southerly portion of the property. • Removal of 170 trees. The site is located at 4550 Carman Drive. The staff coordinator is Elizabeth Jacob. Continued from the December 18, 2000 DRC meeting. Mr. Pishvaie informed the Commission that the applicant has requested for continuance to the January 17, 2001 hearing. Ms. Morales moved for continuance of LU 00-0071, to January 17, 2001 DRC meeting. Mr. Powers seconded the motion and it passed with Mr. Cushing, Ms. Morales, Ms. Ostly and Mr. Powers voting yes. VI. GENERAL PLANNING Mr. Cushing asked Mr. Pishvaie to explain the procedure which allows for an Expedited Land Use Review because it by passes the Design Review Commission and the City Council processes. Mr. Pishvaie explained that a few years ago the State Legislature had established special criteria for projects that if qualified would preempt City Codes in order to be reviewed administratively. The review process for Expedited Land Divisions is longer than the regular review process by DRC. He noted the DRC process is approximately 30 days long from the date the project is determined to be complete; however, the Expedited Review renders a decision within 63 days of the date a project is determined to be complete. Mr. Cushing asked about the trees which are marked on the Avamere project. It was the Commission's desire to have the trees that are to be saved/removed marked clearly. They stated that there are many different colored ribbons on the trees out there currently, and they need to be more clear. Mr. Pishvaie explained when you look at the site, there are a lot of ribbons on different types of trees and tree groves. Ms. Morales asked what is happening on the corner of State/A Avenue. Mr. Pishvaie explained the City is currently working with developer on a Development Agreement. Mr. Pishvaie noted the Commission may have a worksession to work with the developer on design options for Block 138. Ms. Morales noted the City of Portland will get together with the developer and have discussions and not take any testimony. She also noted that to cover such a large project Development Review Commission Minutes Page 2 of 3 January 3, 2001 as Block 138 in a public hearing, is too large and we could miss the big picture. Mr. Cushing concurred that the Commission would like to get as much information as possible and have it ironed out and clearly understood before the public hearing. Mr. Pishvaie noted this is a sensitive project and it makes sense to iron out as much of the details as possible before the hearing. Mr. Boone explained the 120 day review memo, that he handed out. He noted that if new material has been handed in at the hearing, and it's a substantial modification to the material which has already been reviewed, then you can restart the 120 review period on it. Mr. Cushing asked if it only applied to the applicant? Mr. Boone noted if they make a modification of their application then they need to restart the 120 days. Opponents are allowed to submit new evidence, this is their first chance to make a submittal. Mr. Pishvaie noted that the applicant has had ample time to submit new evidence, and it's not fair to expect staff to review this material at the time of the hearing. Mr. Boone stated the opponents have only had approximately 20 days to get their thoughts and objections in order, rather than the time period that the applicant has had in order to present their case. Mr. Cushing asked if the applicant doesn't want to extend the 120 days, do we have to accept it? Mr. Boone stated you have to rely on staff to recommend that it's a modification to the application, or if staff will have sufficient time to review the information. Mr. Pishvaie noted that if you have to review grading reports, traffic reports, etc., staff will need additional time to review this material. It's unfair to expect staff to analyze new evidence the night of the hearing if the applicant has made substantial changes to the materials which have already been submitted. If the applicant wants to do a good job they shouldn't have a problem with extending the 120 day period because they are submitting new materials to help the Commission make their decision. VII. ADJOURNMENT There being no further business before the Development Review Commission, Chair Cushing adjourned the meeting at 7:40 PM. Respectfully submitted.
