The Development Code currently does not include standards that directly regulate seasonal outdoor dining enclosures. The enclosures are treated as building additions that must meet all the standards associated with permanent additions. The issue raised is should these seasonal outdoor dining enclosures be considered "temporary" because the enclosures would be used from October—April and completely removed in the warmer months where outdoor seating would remain. BACKGROUND A pre-application meeting was held for two proposed seasonal outdoor restaurant enclosures for Bamboo Sushi and Chuckie Pies at the Windward site. Because the site is located in the Downtown Redevelopment Design District, the proposed enclosures trigger design standards that require compliance with Lake Oswego Style and prohibit the proposed vinyl windows. Approval of a design variance is necessary to allow the enclosures. The land use process would take approximately 3-4 months to process and $2,042 in fees, not including building permit fees. A City Council policy is to "actively encourage business investment and expansion by: Reducing regulatory barriers (complexity, time and cost in processing applications, amount and scope of regulations) wherever possible, without sacrificing community aesthetics and livability." NEXT STEPS The next step is to learn more about the restaurant owners' desire for seasonal outdoor enclosures, industry standards for these enclosures, potential safety/building code issues, aesthetic concerns, and neighborhood issues. Staff proposes to conduct two focus groups to understand the scope of the issue. One meeting would be with restaurant owners, including those with existing outdoor dining areas on private property; representatives of the Lake Grove 503.635.0215 380 A Avenue PO BOX 369 Lake Oswego, OR 97034 www.ci.oswego.or.us Page 2 Business Association and the Lake Oswego Chamber of Commerce would be invited. Staff will also meet with representatives of affected Neighborhood Associations. Staff would like to assess demand for the enclosures, including geographic areas of focus (zones), needs of the businesses, major hurdles of the permitting process, and any concerns from the neighborhoods. The tentative schedule is to conduct the focus groups in February/March and bring the results to the Planning Commission for a work session on April 13. The City's goal is to have code amendments prepared for Planning Commission review this spring, and City Council review and adoption with an effective date no later than August. ATTACHMENT A.
