Argument in opposition to Resolution 20-07
Submitted to Metro and Lake Oswego
I favor parks and open spaces available to our regions' residents, and acted accordingly when assisting
my parents sell/donate our family home to Lake Oswego [Stevens Meadow] and METRO [Pecan Creek
natural area]. Our property was conveyed into City ownership subject to clear deed restrictions and
reversionary interest.
Based on this personal transaction, I oppose adoption of Resolution 20-07.
Firlane- Proposed Use
The following statements are copied/pasted from LO's documents supporting PP 19-0012
Statement 1:
The existing Firlane Farm House can be used as the Urban Ag/Environmental Education Center for
programming and classes. [page 25, draft Luscher Farm Concept Plan, Dec. 23 2019 edition]
Statement 2:
The Firlane property deed states that the property "shall not in any event be used for any commercial
purposes or construction of a school."8 This needs to be clarified as it may mean that programs such as
the existing CSA that are agricultural, but also commercial in the sale of produce, may not be allowed on
the property. This is also the proposed site for a education center so it should be clarified that this does
not fall under the definition of a school. [page 7, Agricultural Recommendations for Luscher Farm,Jan.
15, 2015 and Luscher Area Master Plan,July 25, 2013, p.9]
If clarification suggested in Statement 2 exists it would be helpful to publish it. Otherwise, a layperson's
reading leads me to believe LO is not allowed to re-construct the Lang home in which to conduct fee-
paid classes or sell CSA licenses on the property sold by Louis and Violet Lang.The mere passage of time
does not obviate the Lang's intent or release LO from their bargain.
Reject this Resolution 20-07 pending a legal opinion verifying the proposed use conforms to the intent
and plain language of the deed.
