EXECUTIVE SUMMARY&ACTION REQUESTED
This memo provides background on the Commission's upcoming work session scheduled for
June 14, which will include a presentation from staff regarding a proposed work plan and
outreach process for the next phase of the City's work to reach compliance with House Bill 2001
(HB 2001).
Staff is seeking the Planning Commission's input on the topics that the Ad Hoc Committee
should address and the Committee's process for this next phase, which will include code
development as well as the public review and adoption of code changes.
BACKGROUND
At a joint study session of the City Council and Planning Commission held on May 18, 2021,
Council directed staff to assist in the establishment of an Ad-Hoc Advisory Committee to help
refine code concepts as the City moves closer to adopting code that complies with state middle
housing requirements under HB 2001 (see Attachment A).
At their meeting on June 1, 2021, City Council adopted Resolution 21-18 (see Attachment B) to
create a Middle Housing Code Advisory Committee (MHCAC) to help the City develop a
response to HB 2001 that meets Council's initiative to, "Adopt codes that comply with HB 2001
that are consistent with the community's sense of place, neighborhood character, and
livability." Per Attachment B, the MHCAC is to be a representative group of community and
industry representatives that is tasked with making recommendations to the City Council and
Planning Commission consistent with this objective, and to provide guidance to staff and the
Planning Commission as the City promulgates code.
The MHCAC would be comprised of a balanced membership of no less than 7 and no more than
13 voting members representing a diverse set of interests, as follows:

The MHCAC would meet up to 5 times between June and September of 2021 in order to engage
in focused discussions on policy issues and concepts pertinent to middle housing (see
Attachment C). The MHCAC would follow a schedule that will allow the Planning Commission to
consider recommended code amendment concepts by October 2021, so that the City Council
may adopt HB 2001-compliant code amendments by the June 2022 deadline.
PHASE TWO WORK PLAN
While the MHCAC will play a critical role in refining the recommendations in the Middle
Housing Opportunities Report (contained in Attachment B) and providing guidance to the
Commission in their future consideration of code options for middle housing implementation,
the Advisory Committee process is one of several steps that the City will need to take to
develop adoption-ready code amendments.
Based upon the initial, conceptual policy-level guidance from the MHAC, staff proposes that the
Planning Commission would then address the details of potential draft code provisions at a
series of public work sessions extending through early 2022.
As outlined in Attachment C, staff also proposes "check-ins" with the City Council prior to the
recommendation of draft code amendments for consideration at a public hearing— including at
possible joint study sessions with the Planning Commission. These meetings are intended to
provide the Council with several opportunities to refine policy direction relevant to the
implementation of middle housing, and will allow the Planning Commission to provide input to
City Council and receive timely guidance from the Council.
The intent is for these work sessions and meetings to culminate in a series of public hearings in
March through May 2022 (see Attachment C), where both the Commission and Council will
receive public testimony and consider draft code amendments for final adoption.
Public Outreach and Community Engagement
To supplement the aforementioned Advisory Committee process, Planning Commission work
sessions, and Council meetings, staff proposes that the City continue to provide opportunities

for public input from the broader community, while ensuring the public is informed of the City's
efforts related to HB 2001 and middle housing.
This would include a Middle Housing Informational Session to be held over the summer in
order to provide residents with a basic understanding of the HB 2001 legislation and middle
housing. The public will also receive information on how to have input on the draft code
concepts and amendments.
Staff also proposes that the City host two Community Forums in order to ensure that the
broader public is informed of the City's efforts related to middle housing. Staff suggests that
Community Forum #1 would take place towards the end of the Advisory Committee process, in
September or October of this year, and would focus on the recommendations developed by the
MHCAC. Community Forum #2 would take place in early 2022, and would focus on the draft
code recommendations, before the Planning Commission hearings begin in spring of 2022.
Additionally, staff will also make themselves available to support neighborhood associations
who may want to lead public involvement efforts in their respective neighborhoods. Staff—and
potentially consultants under City contract—will be prepared to attend neighborhood
association (NA) meetings on request—to listen to resident concerns, make brief presentations,
as needed, and/or answer questions about the process for compliance with House Bill 2001:
• For an approximately three-week period coinciding with the culmination of the MHCAC
process in September or October of this year, staff will be available to present on the
MHCAC's conceptual code- and policy-related recommendations; and
• For an approximately three-week period coinciding with the refinement of draft code
amendment language in early 2022, staff will be available to discuss specific draft code
recommendations from the Planning Commission and City Council.
Staff will be in touch with NA chairs with more specifics regarding this outreach, including the
specific time windows during which this support will be available and parameters regarding the
number of presentations per neighborhood association. Neighborhood associations will be
encouraged to coordinate with one another to arrange for joint-sessions with other NAs in
order to ensure the efficient use of staff time and City resources. Concerns identified by NA
members through this outreach would be provided to the Planning Commission for
consideration in their ongoing process to develop code amendments that comply with HB 2001.
These outreach opportunities will be reinforced by a social media strategy that will include
ongoing updates and announcements in the City's Hello LO publication, as well as posts on
other social media avenues used by the City such as Twitter, Facebook, Instagram, and
Nextdoor.

RESOLUTION 21-18
A RESOLUTION OF THE LAKE OSWEGO CITY COUNCIL CREATING AN AD HOC MIDDLE HOUSING
CODE ADVISORY COMMITTEE
WHEREAS, a goal of the Lake Oswego City Council is to "Conserve the community's quality of life
by planning for change and growth"; and
WHEREAS, a City Council initiative is to "Adopt codes that comply with HB 2001 (House Bill
2001-Middle Housing) that are consistent with the community's sense of place, neighborhood
character, and livability"; and
WHEREAS, the City Council desires to create an Ad Hoc Middle Housing Code Advisory
Committee consisting of citizens interested in helping the City Council and Planning Commission
develop a response to HB 2001 that meets the Council's goal;
BE IT RESOLVED by the Lake Oswego City Council that:
Section 1. As authorized by LOC 12.50.005, there is hereby created an Ad Hoc Middle
Housing Code Advisory Committee (the "Committee") consisting of not more than 13 voting
members and not fewer than 7 voting members appointed by the Mayor and approved by the
City Councilors, as follows:
Development Review Commission (1 member)

Historic Resources Advisory Board (1 member)
Planning Commission (1 non-voting member)
Sustainability Advisory Board (1 member)

Section 2. The term of the committee will be from the date of this resolution through
September 30, 2021, unless concluded earlier or extended by a resolution of the City Council.
Section 3. The Committee's is charged with making recommendations to the City Council and
Planning Commission consistent with the following objectives:
• Conserve the community's quality of life by planning for change and growth;
• Ensure compliance with HB 2001 (House Bill 2001-Middle Housing), consistent with the
community's sense of place, neighborhood character, and livability;
• Provide guidance to staff and the Planning Commission as the City promulgates code
• Follow a schedule that will allow the Planning Commission to consider recommended
code amendment concepts by October 2021, so that the City Council may adopt HB
2001-compliant code amendments by June 2022.
Section 4. The Committee is tasked with reviewing the City of Lake Oswego Middle Housing
Opportunities Report (May 2021) and recommending code amendment concepts consistent with
the above objectives. The Committee's work shall be accomplished in not more than five
meetings during July through September 2021.
Section 5. At its first meeting, the Committee shall elect a Chair and Vice Chair, as provided
in LOC 12.50.025. The Committee shall follow all provisions of LOC Article 12.50 that apply to ad
hoc committees, except that, instead of requiring a simple majority of the members present
and eligible to vote to decide any question [LOC 12.50.030.2], a vote by two-thirds of the
members present and eligible to vote will be required to decide any question.
Section 6. The Committee shall comply with all requirements of Oregon Public Meetings
Law, ORS 192.610 et seq.
Section 7. Any member who is absent for two consecutive meetings of the Committee is
automatically removed from the Committee and new members will not be appointed to fill
their positions.
Section 8. This Resolution shall be effective immediately upon its adoption by the City
Council.

BACKGROUND
Consistent with the City Council initiative to, "Adopt codes that comply with HB 2001 that are
consistent with the community's sense of place, neighborhood character, and livability," staff
and consultants with Cascadia Partners recently completed the first phase of work toward the
adoption of Community Development Code (CDC) amendments in compliance the bill.
At a joint study session of the City Council and Planning Commission held on May 18, 2021, staff
was provided with direction regarding the second and final phase of work—code development
and public review and adoption of code changes. This included direction to create an Ad-Hoc
Advisory Committee to provide high-level policy guidance to the Planning Commission on key
issues related to middle housing implementation, before staff begins drafting code
amendments for the Commission's review.
DISCUSSION
For the next phase of work to comply with HB 2001, staff recommends that City Council appoint
an ad-hoc Middle Housing Code Advisory Committee (MHAC) as described in Attachment 1.
The MHCAC would be comprised of a balanced membership of no less than 7 and no more than
