Hi Jamin,
The standards in Division 46 apply to middle housing as defined in that section.The definition of plex
developments is that they are attached but a local government may define them as detached.
Because detached plex developments meet that definition,they are subject to the regulations in
Division 46.
That said,the city could still apply a building orientation standard detached plex developments
under a few different paths: 1) they could apply the building orientation standards that are provided
in the Large Cities Middle Housing Model Code or 2) they could apply a different building orientation
standard to detached plexes but justify the standard through findings utilizing the Alternative Siting
and Design Standard process in OAR 660-046-0235. I would imagine that be pretty easy to show that
a building orientation standard wouldn't cause unreasonable cost or delay as described in -0235.
I've attached a flow chart that outlines the possible paths to apply standards not considered in
Division 46.

Hello Ethan,
The City of Lake Oswego is considering allowing for detached duplexes/triplexes/quadplexes as part
of their HB 2001 amendments. If they do so, do the siting and design standards have to conform to
Division 46 requirements? Or does Division 46 only apply to detached plexes?
For example-can the City apply a building orientation standard to detached quadplexes, even if they
do not apply the same standard to single-family detached houses?Assume the standard also differs
from the Model Code, so it doesn't meet one of the two options for Division 46 compliance re:
design standards.
Also, I assume the City must provide a set of clear and objective standards for detached plexes, as
this requirement applies to all needed housing?
