PLANNING COMMISSION MINUTES APRIL 10, 1972
The regular meeting of the Lake Oswego Planning Commission was
called to order by Chairman Rohde at 7:30 p.m. Members present
were Ralph Coan, Duane Lafferty, Steven Schenk, Ardis Stevenson,
Roy Thompson and Ron Travers. Staff members present were Bob
Mahoney,Planning Director; Marlin DeHaas, Director of Public
Works; Jim Cox, City Attorney and Mindy Klann, Planning Commission
Secretary.
It was moved by Thompson and seconded by Lafferty to approve
the minutes of the meeting of March 27, 1972. The motion
passed unanimously.
UNFINISHED BUSINESS
Mt . Park Corporation, Phase V-B - A public hearing was held for
Planning Commission consideration of revised resolutions for the
adoption of Phase V-B, Mt. Park Planned Unit Development.
Mr. Lafferty moved that the matter be continued untl the next
regular meeting of the Planning Commission since the Commission
had just received the revised resolutions and would need more
time to review them. The motion was seconded by Thompson and
passed unanimously.
Mt. Park Phase III - A plan review was held at the request of
the Planning Commission for Mr. R.W. Miller representing single
family property owners residing on Touchstone.
Mr. Mahoney presented the land use plan for Phase III of Mt. Park
and invited Mr. Miller to view them. Mr. Miller told the
Commission that it was not really the townhouses that he objected
to but the lack of buffer between their rear yards and the town-
house site. He also presented a photographic display indicating
existing ground cover and elevations on the area in question.
It was pointed out that a minimum of 35 feet between building
lines for single family and townhouses had been approved by the
City in order to adequately separate buildings.
Mr. DeLong, Touchstone; Mr. Mike Harwood, Falstaff E. ; Mr. Fred
Bremner, Touchstone; and Mr. Harry Douglas, 18 Touchstone all
spoke in oppostion and requested that the Planning Commission
initiate a zone change on property lying between their rear
yards and the townhouse site in order to provide a larger buffer
strip.
Mr. Rohde told the property owners that Mt. Park had developed
Phase III in accordance with the plans as adopted by the Commission
and that since there had been no change of circumstances in the

area not had there been an error in the original proposal , the
Planning Commission had no authority to initiate such a change.
He went on to tell them that if they felt that they had been
misrepresented by Mt. Park when they purchased their lots, that
they should seek legal advise instead of requesting a zone
change.
PUBLIC HEARINGS
Mrs. James G. Swindells - A public hearing was held at the
request of Mrs. James G. Swindells for a conditional use and
variances to allow the construction of a four unit multi-family
structure on the easterly 2 of Lots 6 and 7, Block 138, First
Addition to the Town of Oswego.
Mr. Mahoney gave the staff report. Mr. Swindells spoke as pro-
ponent for the request giving a history of the property in ques-
tion and the difficulty there has been renting the business space
that had existed prior to the fire. He proposed a mixed use with
commercial on the State Street level with four units above. Mr.
Mahoney advised the Commission that Mr. Swindells proposal varied
from the application as submitted since the original proposal
suggested no commercial with only four units requested.
Mr. Ormond Bean also spoke in favor of the request and asked
that the Planning Commission not concern themselves with the
details of the development, but with just the conditional use
itself, and if the use were granted they would return with
detailed plans at a later date.
Councilman Needham spoke in opposition to the request stating
that he felt the apartments would be incompatible with the
surrounding uses, there would not be adequate parking and that
there would be increased traffic congestion.
In discussing the parking situation, Mr. Lafferty suggested that
the existing structure at the southwest corner of the City Hall
could be torn down to make room for parking on the site in ques-
tion.
Mr. Travers told the Commission that he felt the use was a good
idea but that he would like to see a more complete application
which provided parking on the site.
It was then moved by Lafferty and seconded by Travers to continue
the matter until the meeting of April 27, 1972 pending a more
complete application.
William Woodard - A public hearing was held at the request of
William Woodard for a front, side and rear yard setback variance

to allow the construction of an addition to the existing dwelling
and a garage on Tax Lot 1, Lot 319, Lake View Villas. Mr. Mahoney
showed slides of the property in question and presented the staff
report.
Since Mr. Woodard also owned the adjacent vacant lot, it was the
feeling of the Planning Commission that a variance was unnecessary
since he could simply locate his additions in that direction.
Mr. Woodard explained to the Commission that the additions were
to be to the kitchen and the family room which ware already located
on the south side of the lot, and that the relocation of plumbing
and electrical facilities would more expensive if the addition
were made to the north side of the house.
With that, it was moved by Travers and seconded by Coan to grant
the additions to the south side of the existing dwelling with the
condition that the existing carport be removed and that the
proposed garage be constructed on the north side of the house. on
the adjoining lot. The motion passed unanimously.
Study Area 3A - A public hearing was held to consider the change
of zoning on Study Area 3A as described in the City' s R-7.5 Report
from R-7.5 to R-20, R-15 and R-10.
Mr. Mahoney gave the staff report and read telephone messages re-
ceived from Mrs. Phillip Ford, Mrs. Felix Calkins, and Mrs.
William Barber; all in favor of the proposed change of zone.
He also read a letter supporting the zone change from Mr. and
Mrs. George Cassarno. Mrs. Hurtado spoke in favor of the change
and urged the Commission to maintain the building moratorium until
sewers were made available to the property. Those speaking in
opposition to the request were Ken Parelius, Bill Ling and
Peter Werner.
Mr. Parelius told the Commission that he had his property sur-
veyed and platted at an R-15 density. The results of the survey
showed long "cigar-shaped" lots, whereas if the zoning remained
at R-7.5, he would be able to have more conventional shaped lots.
Mr. Ling told the Commission that his property was on the easterly
most edge of the proposed R-20 zone and that he felt a step from
R-20 to R-7.5 would not be consistant and that he would request
a zone of R-15 for his property.
The public hearing was closed. After discussion by the Commission
as to the development in the area, traffic problems, protection
of property values afforded by the zoning, it was moved by Coan
and sec aided by Thompson that that portion of Study Area 3A
proposed for R-20 zoning remain R-20 with the exception of Tax

Lots 1500 and 1600, 21E 10CB to be zoned R-15; that the proposed
R-15 area remain R-15 with the exception of that portion lying
east of Palisades Terrace and west of Patton which shall be
zoned R-10; and that zoning on the north side of Oak street on
a line parallel with Oak Street between the east and west inter-
section of Palisades Terrace and Oak Street be R-10. The motion
passed unanimously.
Study Area 3C - A public hearing was held to consider the change
of zoning on Study Area 3C from R-7.5 to R-15. Mr. Mahoney
presented the staff report.
Mrs. Evelyn Giesy spoke in favor of low density zoning in the
area.
It was moved by Coan and seconded by Lafferty that the portion
of Study Area 3C which was zoned SR-10 be left at SR-10 and
that the remainder of the area be zoned R-15. The motion passed
unanimously.
S-J Development - A public hearing was held at the request of
S-J Development for the removal of seven trees to allow the con-
struction of Weatherstone Village in Mt. Park Planned Unit
Development, Phase III. Mr. Mahoney presented a plot plan of the
proposed development indicating the location of the trees to be
removed. Mr. Alan Stewart of S-J Development spoke as proponent
for the request stating that they had done considerable engineer-
ing in order to save the maximum number of trees possible.
It was moved by Coan and seconded by Thompson to approve the
application as submitted. The motion passed unanimously.
Ditz-Crane Homes - A public hearing was held at the request of
Ditz-Crane Homes for the removal of trees to allow the construc-
tion of Touchstone Townhouses in Mt. Park, phase III.
Mr. Mahoney presented a plot plan of the proposed development
which indicated -the general location of trees to be removed.
A representative for Murry-McCortack Engineering explained the
reasons for the removal of the trees.
The planning Commission felt they needed a more precise diagram
of the trees to be removed to indicate their size, location and
species. It was moved by Stevenson and seconded by Coan to
continue the hearing for verification of the conditions of the
application. The motion passed unanimously.
Security Signs - A public hearing was held at the request of
Security Signs, Inc . for a sign area, height and length variance

to allow the construction of a sign for the Radio Shack to be lo-
cated at 27A "A" Avenue.
Mr. Mahoney gave the staff report and recommended denial of the
application as proposed.

Mr. A. M. Fulton spoke as proponent for the request stating that
the proposed sign was a standard sign furnished to the Radio
Shack chain.
It was moved by Lafferty and seconded by Thompson to deny the
application as proposed. The motion passed unanimously.
SUBDIVISION REVIEW
Palisades Heights #5 - A subdivision review was held at the request
of Lake Oswego Properties for Planning Commission consideration of
the re-submission of preliminary plans for Palisades Heights #5.
Mr. Mahoney presented a copy of the proposed plat to the Planning
Commission and advised that the plat had not been recorded within
the required six month period.
It was moved by Coan and seconded by Thompson to approve the
preliminary plat as submitted. The motion passed unanimously.
The meeting was adjourned at 10:55 p.m.
