In the event of any 25 inconsistency between the supplementary matter herein and the staff report, the matter herein 26 controls. 27 28 Following are the supplementary findings and conclusions of this Commission: 29 30 1. Policy Item #2— Maximum Size of Boathouses [LOC 50. 04.003.7.b]. The Commission 31 received testimony from Mark W. Eves and Bob Barman (Exhibits G-1, G-2, and oral 32 testimony). Both testimonies contended that the proposed reduction to the maximum 33 size of boathouses would not allow sufficient area to store a boat along with space for 34 other items that need to be stored, such as boat accessories, outdoor furniture, water 35 toys, and yard equipment (Exhibits G-1 and G-2). Mr. Eves stated that the floodplain 36 ministerial variance square foot maximum should not be a factor because many of the 37 boathouses are not located within the floodplain and that the Lake Corporation already 38 does a good job regulating the size of boathouses. Mr. Eves stated the standard should 39 remain as is or there should be no maximum size for boathouses. Mr. Barman stated 40 concerns regarding insufficient access space for elderly or disabled people to board a 41 boat with the proposed boathouse size limit of 500 square feet. The testimony did not 42 identify any applicable Comprehensive Plan policy contrary to the proposed 43 amendment. LU 21-0057-2884 Page 2 of 4 APPROVED: 02/14/2022 1 2 The Commission finds that the 60-square-foot difference between the proposed 3 maximum size of 500 square feet and the current 560 square feet is inconsequential in 4 term of visibility and sightlines along Oswego Lake. The current standard allows for 5 sufficient storage space and does not create significantly larger building massing. The 6 Commission finds that it is not necessary to align the standards in LOC 50.04.003.7.b 7 with the Floodplain ministerial "boathouse variance" or the Lake Corporation private 8 standard with a maximum size of 500 square feet. 9 10 The Commission finds that the first part of Policy Item #2 to reduce the maximum size of 11 boathouses should not be recommended to be approved by the City Council, however 12 the Commission finds that the second part of Policy Item #2 that clarifies that side and 13 rear yard setbacks do not apply to boathouses within the Oswego Lake setback is 14 recommended for approval by the City Council. 15 16 2. Maintenance Item #1 and Policy Item #3- Building Design Standards [LOC 17 50.06.001.5.b.i and ii]. Staff received questions on why the staff report did not address 18 Oregon Planning Goal 10: Housing, in regards to the proposed amendments to the 19 building design standards (Maintenance Item #1 and Policy Item #3). 20 21 The Commission finds that those proposed code amendments: 22 • Do not change allowed density, uses, housing types, Comprehensive Plan Map or 23 zoning on any property; 24 • Do not discourage the construction of housing because the amendments are 25 clarifying the existing design standards that already apply; and 26 • Will have no effect on the Buildable Lands Inventory. 27 Further, the Commission finds that there are clear and objective design standards for 28 multi-family development under LOC 50.06.001.7 that are allowed under ORS 29 197.307(6) and will not be changed with the proposed amendments. Multi-family 30 development may comply with the clear and objective building design standards in lieu 31 of the discretionary building design standards in LOC 50.06.001.5 affected by the 32 proposed amendments. For the reasons listed above, Goal 10 is not applicable. 33 34 ORDER 35 36 IT IS ORDERED BY THE PLANNING COMMISSION of the City of Lake Oswego that: 37 38 1.
