Planning Commission Action Minutes
September 12, 2022
1. CALL TO ORDER
Acting Chair Heape called the meeting to order at approximately 6:30 p.m., in the Council
Chamber of City Hall, 380 A Avenue, Lake Oswego, OR 97034.
2. ROLL CALL
Members present were Chair Rob Heape, Miles Rigby*, Diana Moreno and Don Phillips. Chair
Helen Leek and Commissioners Don Mitchell and Philip Stewart were excused. Council Liaison,
Jackie Manz was also present.
Staff present were Scot Siegel, Community Development Director; Erik Olson Long Range
Planning Manager, Evan Boone, City Attorney; Iris McCaleb, Administrative Assistant; and
Cristina Siquina Calderon, Administrative Support.
*Participated remotely.
Election and Nomination of Acting Chair for this Evening’s Meeting
Commissioner Heape moved to hold an election and nominate an acting chair for this evening’s
meeting. Commissioner Moreno seconded the motion and it passed 4:0.
Commissioner Phillips moved to nominate Commissioner Heape as Acting Chair for this
evening’s meeting. Commissioner Moreno seconded the motion and it passed 4:0.
3. COUNCIL UPDATE
Councilor Manz provided an update on recent Council activity.
Action Items:
• Councilor Manz will discuss a concern brought up by Acting Chair Heape with the City
Manager regarding an apparent new fee to charge Electric Vehicles (EV) at City Hall for up
to two hours and a .75/hour parking fee after two hours.
• Councilor Manz noted Acting Chair Heape’s statement that it has been very helpful for the
Planning Commission to stay focused specifically on whether the code requirements have
been met or not in quasi-judicial matters and avoid superfluous discussion. Such an
approach may be helpful for councilors in deciding matters like tree code appeals.
4. CITIZEN COMMENT – Regarding issues not on the agenda
None.

5. COMMISSION FOR CITIZEN INVOLVEMENT
Acting Chair Heape announced that the Lake Grove Neighborhood Association would be
holding their annual membership meeting on September 15, 2022.
Carole Ockert, Chair of the Neighborhood Chairs Committee of Lake Oswego, introduced
herself to members of the Committee; she also announced that at their next meeting on
Saturday they would hold a forum and a “meet and greet” with City Council candidates.
6. MINUTES
6.1 July 25, 2022
6.2 August 8, 2022
Consideration of the draft minutes were deferred to a future meeting.
7. WORK SESSION
7.1 Nonconforming Residential Development – Work Session #3 (PP 22-0002/LU 22-0008)
The Commission continued its review of the requirements for nonconforming residential
developments. Staff coordinator was Scot Siegel, Community Development Director.
Carole Ockert, representing the Neighborhood Chairs Committee, requested that the
Commission move forward with the public hearing at the earliest possible date.
Acting Chair Heape moved to direct staff to proceed with the Planning Commission public
hearing. Commissioner Moreno seconded the motion and it passed 3:1.
Action Items:
• The Commission directed staff to return on September 26 for a final work session to continue
review of options and receive input from Commissioners not present at this evening’s meeting.
8. OTHER BUSINESS
• Planning Commission Fall Retreat and Training Opportunities – no updates until Chair Leek
meets with staff for goal setting.
9. SCHEDULE REVIEW
Mr. Siegel reviewed the schedule.
Action Items:
• Staff will return on September 26, for Work Session #4 Nonconforming Residential
Development (PP 22-0002/LU 22-0008).
• The Planning Commission meeting scheduled for October 24 has been moved to Tuesday
October 25, due to Municipal Court holding a jury trial.
10. ADJOURNMENT
There being no further business, Acting Chair Heape adjourned the meeting at 7:40 p.m.
