The applicant is seeking approval of a planned development composed of ten lots (with existing dwellings) and common property (with existing garages, off—street parking, landscaping and a proposed gazebo). The applicant is also seeking approval of two Class II variances: A 25 foot variance to the Access Standard which requires that each lot abut a public street for a minimum of 25 feet; each of ten proposed lots and the landscaped common area does not abut a public street [VAR 3-92(a)1; and a variance to the Floodplain Standard which requires that new construction and substantial improvement ` have the lowest floor elevated one foot above the base flood; the applicant proposes that the lowest floor of each of the dwellings on the ten proposed lots remain as existing, 1 • below the base flood elevation, 1 C. The burden of proof in all cases is upon the applicant seeking approval. The applicant has submitted the documents marked as exhibits, accompanying this report. The adequacy of these exhibits will be discussed in this report. 7fa 4 2. For any development application to be approved, it shall first be established , • that the proposal conforms to: a. The City's Comprehensive Plan i Applicable policy groups are: Urban Service Boundary Policies These policies require the City to manage and phase urban growth within the Urban Service Boundary, with a logical planned extension of basic services. Specific Policy 5, which is used as a guide in interpreting the meaning of the General Policy, states that , new development shall be serviced by an "urban level" of services, including schools. This specific policy also states that these services are to be available or committed prior .. to approval of development. A City Council memorandum of September 18, 1990 demonstrates that the current level of school planning and coordination between the City ar.d School District satisfy this General Policy. The passage of the 17 million dollar " school levy on November 7, 1989 further assures adequate school facilities., Impact Management Policies • ' ,. These policies require protection of natural resources from development, including trees and tree groves, and require n,placement of trees whose removal is necessary for • development to occur. These policies encourage the City to provide flexibility in site planning to achieve innovative solutions to development impacts and to adapt that development to site conditions, especially natural resources, These policies require ,H:: mitigation of the visual impacts of development on adjacent properties through buffering . • or other means. The policies further require comprehensive review of development proposals, and payment of an equitable share of the costs of public facilities, These policies are implemented through several Development Standards, addressed further below. These policies require assurance that distinctive areas will be preserved, ' soil will be protected from erosion, trees will be protected from removal and that density will be limited when necessary to achieve these results, Compliance with the applicable .y Development Standards reviewed below will assure conformance to these Plan policies. `` Conditions of approval will be imposed when necessary to assure compliance. • Wildlife Habitat Policies These policies require the City to protect upland habitat and to assure preservation of natural vegetation. These policies are implemented through the Tree Cutting Ordinance, .`. No other development standards or regulations are applicable to this site with regard to ,, these policies. ,r � •ht..' Distinctive Natural Area Policies ; " These policies require the City to preserve the general wooded character of Lake Oswego and to protect the natural functions served by native tree stands and yard trees. These policies arc implemented through the Tree Cutting Ordinance, reviewed later in this report. These policies are now implemented k through the City's Solar Access Ordinance (LOC Chapter 57) which will be reviewed later in this report. The City has acquired an easement along the north shore of Lakewood Bay for use as a pedestrian boardwalk. A connection to an existing 6 ft.—wide pathway is necessary to link the boardwalk to 3rd Street. This will be discussed later in this report. 7iii tow r Im..nsportation_Policies Q ,',- $ These policies require the dedication of adequate right—of—way for planned travel lanes and pedestrian paths. The policies require the maintenance of quite residential streets, with priority on neighborhood livability and minimum necessary scale. The City is • required to provide protection from conflicting uses for future options for efficient transportation, including railroad rights--of—way. I '. - The proposal includes existing and proposed pedestrian pathways and the railroad right— of—way of the Southern Pacific Transportation Company. These features will be discussed later in this report. • `. b. The applicable statutory and Code requirements and regulations, including: ` ' i. For variance applications, the standards found in LOC 48.650. Zoning Code Requirements and Analysis (LOC Chapter 48), The site is zoned WR which requires a minimum lot area of 3,375 sq. ft. per dwelling unit[LOC 48.135(1)]; no minimum lot width at the building line is required [LOC 48.135]; no required minimum lot depth is required [LOC 48,135]. Maximum lot • coverage allowed in the zone is 100% [LOC 48.140]. The zone requires no minimum setbacks [LOC 150(6)]. The Oswego Lake Special Setback[LOC 48.535(3)] do not apply to this project because it is in a WR zone. •'IA The applicant proposes the parcels to be the sizes indicated in the narrative (page 11, Exhibit 2). The Planned Development proposed allows the overall density to achieve the minimum lot area of the zone to be achieved in an average throughout the project. The maximum height allowed in the zone is 24 ft. measured from the surface of Oswego Lake [LOC 48.155(4)], . n The only uses permitted in the WR zone are single—family dwellings or cluster • developments erected on pilings over the water of Lake Oswego [LOC 48,127], The proposal complies with all applicable zoning. The proposed gazebo and existing garages are accessory structures allowed per LOC 48.505(5), Written testimony by Lake Oswego Corporation (Exhibit 22) expresses concern about the appearance of the extent proposed structures and to which they may extend into the lake, 11. el yet remain on private property. None of the 10 lots, nor the associated common property abutting it is proposed to abut a public street. } As per LOC 49.510(1), the Development Review Board must consider the following criteria when evaluating a request for a Class II variance [VAR 3_92(a)]: • a. The request is necessary to prevent unnecessary hardship;The portion of the site south of the Southern Pacific Transportation Co, right—of—way ' does not abut a public street and public dedication is notpossible, abuts 3rd Street (Tax Lots 8200 and 10800), While the project the 10 proposed lots do not. The request is necessary in order for the lots to be created, otherwise a hardship will result. b. Development consistent with the request will not be injurious to the neighborhood in which the property is located or to property established to ` be affected by the request; There will be no change in the relationship of the site to the existing 3rd Street right—of— way as it regards the Access Standard; the site does not abut a street, and the 10 lots are not proposed to abut a street. No injury is anticipated as a result, c. The request is the minimum variance necessary to make reasonable use to the property; Since the site of the proposed lots does not abut a street, the request for a full variance to the Access Standard is the minimum necessary to divide the existing 10 dwellings into 10 lots with dwellings on them. d. The request is not in conflict with the Comprehensive Plan, U Transportation policies address the adequacy of public right—of—way and require dedication where necessary. The area south of 3rd Street is owned by SPTC and cannot be required to be dedicated as street right—of—way. These policies also require that such railroad use be preserved for future transportation purposes of an unspecified nature. • The proposed variance appears not to conflict with the Plan, Staff concludes that VAR 3-92(a) satisfies all applicable criteria and may be granted, PD l 92\VAR 3-92(a—b) ., Page 8 of 17 1 VAR 3-92(b): A variance to the Floodplain Development Standard which requires that <' `� substantial improvement have the lowest floor elevated one foot above the base flood. t'�+ -4/-4. "Substantial Improvement" is "any repair,reconstruction, or improvement of a structure, ': J%.1 the cost of which equals or exceeds 50 percent of the market value of the structure"...."before the improvement or repair is started..,." This substantial improvement is considered to occur where the first alteration commences [emphasis added]. As per LOC 49.510(1), the Development Review Board must consider the following criteria when evaluating a request for a Class II variance [VAR 3-92(b)]: a. The request is necessary to prevent unnecessary hardship; The applicant notes that any improvements to a cabana would require elevation of the lowest floor, creating a hardship on the developer and subsequent owners. The hardship E , is believed to be economic, but has not been identified by the applicant. The applicant has not adequately addressed this criterion, particularly with regard to the ' guidelines identified in LOC 49.510(2) regarding demonstration of hardship, what constitutes reasonable use, or economic factors used as justification. b. Development consistent with the request will not be injurious to the . neighborhood in which the property is located or to property established to be affected by the request.; . Approval of the variance and subsequent construction below the level required by the standard will not allow the affected property owner to insure the property for potential • flooding at lower rates intended for owners whose structures are in compliance. Flood Plain (17,005— 17.0401 • ';, This standard requires that the lowest floor of new construction or substantial improvement be elevated one foot above the base flood level, All 10 existiing dwellings proposed to remain are below this requirement. The applicant has requested VAR 3— 92(b) to address this requirement, which was reviewed earlier in this report, -•R: Access Standard (18.005— 18.04Q) • This standard requires that each parcel abut a public street for at least 25 feet, The site of the proposed lots does not abut a public street. For almost fifty years, owners of tax lot 7900 have regularly and frequently traversed the proposed parking lot on the west end of tax lot 10800 to gain access to the railroad in order to go to their ., lakefront easement. This use of the railroad is the same for almost all the properties along Lake Bay Court. The owners of the proposed development already have a well-developed and well-maintained walkway down ,•• to the railroad. The evidence shows that a temporary vehicular crossing can be constructed in the vicinity or the section house, permitting access from the existing road to the "Point of Land" on which the construction work is contemplated. The petition sakes no mention of the necessity for a ternary vehicular crossing at this point, but in the testimony at the hearing, its necessity was pointed out, and Southern Pacific Company expressed its concurrences in such an arrange- 'sent, provided proper safeguarde be used during the existence and ease of the temporary crossing.
