• Resolution 23-14 Initiated the proceedings to vacate, May 2, 2023
• Notices were sent and posted on site
• Questions were received from one adjacent property owner and one resident

Benefit of ROW Vacation
1. Does not appear to be a future need for a public right-of-way.
2. Pathway is undeveloped and not needed for connectivity.
3. Transportation System Plan does not view the pathway as a viable option .
4. Facilitate Affordable Housing development - Habitat for Humanity project, as
envisioned in LU 22-0059, with 23 townhomes.
5. Eliminates the differing public v. private use classifications of the pathway.
6. Does not substantially affect the abutting property owners market value
Questions/ Issues brought forward :
1. Sanitary sewer easement will remain in place on several easterly properties
2. Typical increase in property size — 2% or less, which does not substantially affect
the abutting property owners market value.
3. Individual property surveys are the responsibility of land owners
4. Upper Drive "stub" will not be developed at this time.
S . There is no evidence of this area being used as a pathway. The future
regional pathway system is identified within the TSP, implying use of the
RR right-of-way for any future development of a trail system .
STAFF RECOMMENDATION :
Enact Ordinance 2926 to vacate the public interest in a 6-
ft wide pathway right-of-way located northwesterly of the
railroad right-of-way of Union Pacific Railroad from
Boones Ferry Road to Bryant Road .
