Comments In summary,the devellper has not provided sufficient evidence that the destruction
of land in an RP should be considered,the downplaying of the total defoliation
impact and the lack of concern for adjacent properties is unacceptable.

Dear Ms. Davis,
As residents and homeowners within a block of the affected area, we are sharing our concerns
and the reasons we oppose this project as submiZed.
Ms. Kreb’s comments (on file from July) are reflecbve of many of our own concerns, so we will
focus on some addibonal areas of concern – especially around the plan to violate the ideas
around the need for a resource protecbon area (West Waluga Park, 21E07DB02209, a Class 2
wetland)).
Let ’s begin by reminding you of Lake Oswego’s focus on Sensi&ve Lands including wetlands.
“Lake Oswego residents are commi2ed to protec4ng the community’s unique landscape
and natural environment. These stewardship values are embodied in City policy. The City
of Lake Oswego also has mandates from both Metro and the State that require
preserva4on of Lake Oswego’s natural resources. Regula4on of lands containing
wetlands, stream corridors and certain tree groves falls under the Sensi4ve Lands code.”
The significant violabon and destrucbon required for the sewer through the wetlands seems
unnecessary, especially given other opbons which were dismissed without any details. Short of
elevabon issues, the other large issue likely was financial for the developer. Short of details, one
would assume that the developer selected the least expensive opbon regardless of the
destrucbon of natural habitat of numerous creatures including, for example, bats. This is
important because bats provide a way of managing insects in the vicinity without the need for
harmful insecbcides. Approving this variance request for the RP essenbally guarantees
addibonal harm to the environment for generabons to come.
The area outside of the RP (the three current lots) are always subject to significant drainage
issues (hence “wetlands”). Although they are not an RP, the characterisbcs are similar. There will
be ecological damage done by disturbing and destroying these areas, and I don’t see any
protecbon for landowners of near / adjacent lots to prevent incremental runoff into their
properbes.
The 43 trees (as shown in the aZachment on the planning website enbtled “SITE PLAN”
“BALEINE ST DEVELOPMENT”) are merely the proverbial ‘bp of the iceberg ’. The aZachment
shows nearly 200 addibonal trees – many of which will be removed for the actual homes to be
constructed. The developer ’s focus on the 43 trees is merely a distracbon from the much more
significant defoliabon that will occur aker the trees removed for access lanes and sewers has
taken place.
The path that is created between SW Inverurie Road and SW Kimbell Street is used by
pedestrians and cyclists. I would echo Ms. Kreb’s “Request Considerabon for Baleine Pathway ”.
Without improving the pathway aker the destrucbon of the “43 trees”, this will be a muddy,
dangerous area. I would echo the suggesbon that a boardwalk connecbon between Kimball and
Inverurie is cribcal if this applicabon is approved (and, as noted, we do not support) we would
like to add that the boardwalk must be designed accounbng for the incremental runoff from the
lack of soil absorpbon due to the reduced soil area from the buildings. It should have a
commiZed maintenance plan and be accessible for all abilibes.
In conclusion, Lake Oswego is a very special place, created on an area with established natural
beauty. We would respeclully ask that you please mandate addibonal considerabons from the
developer and review once again with the community before approving the developer ’s
request.
