HomeMy WebLinkAboutNotice Withdrawal CCPH 10-03-23 w-Map AN 23-0005 503-635-0290 380 A AVENUE PO BOX 369 LAKE OSWEGO, OR 97034 WWW.LAKEOSWEGO.CITY NOTICE OF POTENTIAL WITHDRAWAL OF TERRITORY FROM LAKE GROVE WATER DISTRICT The Lake Oswego City Council will hold a public hearing on Tuesday, October 3, 2023, at 5:30 p.m. at City Hall in the 3rd floor Council Chamber, 380 A Avenue, Lake Oswego, Oregon to consider this withdrawal and proposed ordinance. Owners/Applicants: City of Lake Oswego, Erica Rooney, City Engineer | Public Works Director (A) The City of Lake Oswego proposes to withdraw one parcel, shown on the attached map, from the Lake Grove Water District. The parcel is located at: 5022 Upper Drive (21E18AA00400) If withdrawn from the Lake Grove Water District, the subject property will continue to receive water service from the City of Lake Oswego. The withdrawal will occur through the adoption of an ordinance. The title of the ordinance is: Ordinance 2930 An Ordinance declaring the withdrawal of territory consisting of 0.43 acres located at 5022 Upper Drive in the City of Lake Oswego from the Lake Grove Water District (AN 23-0005). APPLICABLE CRITERIA: 1. Oregon Revised Statutes, Boundary Changes; Mergers and Consolidations  ORS 222.524 Procedure for withdrawal of a part of a district from a district.  ORS 222.524(1) Authorizes the governing body of a city to cause the withdrawal from a water district that portion of such district incorporated in or annexed to the city, and to hold a public hearing on the question of such withdrawal. At the hearing, the governing body shall hear objections to the withdrawal and determine whether such withdrawal is for the best interest of the City. 2. Metro Code  3.09.040(a)(1-4) Minimum Requirements for Petitions.  3.09.050 Uniform Hearing Requirements for Final Decisions. Subsections (b)(1-3) and (d) This proposal is initiated by the City of Lake Oswego and will result in the withdrawal of approximately 0.43 acres of territory from the Lake Grove Water District. Please note the following: ORAL ELECTRONIC TESTIMONY BY ZOOM: Prior to 12:00 noon on meeting day notify the City Recorder at: cityrecorder@lakeoswego.city to receive a Zoom link and Zoom phone numbers by 12:00 p.m. Provide name, contact information, and whether you support, oppose or are neither for nor against the application. You must timely connect and testify when called. If you are not able to electronically testify for any reason, e.g., inadequate or faulty internet connectivity, computer equipment, or operation thereof by yourself, internet service providers, virtual meeting platform software, or other third parties involved in transmission and receipt of your oral testimony, you are deemed to have waived your oral testimony. You are strongly urged to also submit written testimony to assure appearance in the proceeding, receipt of testimony, and appeal right. Individuals are allowed up to 5 minutes, and any person attending the hearing may cede their time to another individual; however, in no case will any individual have more than 10 minutes to testify. Recognized neighborhood associations, governments and government agencies, and other incorporated public interest organizations have up to 10 minutes to testify. See LOC 50.07.003.4.a and 50.07.003.4.b. Note: Failure to raise an issue in the hearing, in person or by letter, or failure to provide statements or evidence sufficient to afford the City Council an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
