HomeMy WebLinkAboutApproved Minutes - 1973-03-12 PM• PLANNING COM.MISSION MINUTES MARCH 12, 1973 The regular meeting of the Lalrn Oswego Planning Comm.:l.u1JJ.on was called to order by Chairman Rohde at 7:JO p.m. Membo.1:•u present were Ralph Coan, Joe Glaze, Steve Schenk, Marty Schweu·1 cu1d Ardia Stevenson. Staff members presenr were Bob Mahoney, .Pletnning Director; Marlin DeHaas, Director of Public Works; J";Lm Cox, CityAttorney and Mindy Klann, Planning Commission Secretm:•y. Approval of the February 12, 1973 and February 26, 197J minutes was deferred to the next meeting. PUBLIC HEARINGS Oregon·Slgn Corporation (Engstrom Motor Home Center) - A continued public hearing was held at the 1·0quest of Oregon Sign Co.t>poration for a variance to allow for the placement of a ground mign within the requiredsetback in the MP zone for Eng8trom Motor Home Center at 171�0 Boones Ferry Road. Mr, Mahoney gave the staff report explaining to the Cormnission that this was not a sign variance, but a variance from l;he stan­dards of the MP Zone regarding the placement of the proposed sign,He then gave a brief description of the setback standards for theMP Zone, There was considerable discussion as to whether or not a hardsh:tp did exist. Mr. Dave Johnson, speaJdng as proponent fo1"' the request, told the Commission that the hardship involved in this matter was due to the setback lines running through the existing building, thereby eliminating a place for a ground sign. He also told the Commissio n that due to the placement of the structure on thesite, a wall sign would not be clearly visable from Boone.ti Ferry Road, No one spoke in opposition. The public hearing was closed. It was moved by Glaze and seconded by Schwan to grant the variance subject to the condition that the sign be removed at the time Boones Ferry is widened. The mot.ion was amended by Coan and seconded by Stevenson to increase the setbacks for the sign an additional 5 feet thereby placing the sign back 15 feet instead of 10, The amehdment passed withSchenk opposing. Upon roll call vote, the main motion failed with Coan; Schenk, Stevenson and Rohde opposing . fOl"' Planning Commis sion Minutes -J-March 12, 197J Paul Hebb (Country Square) -A public hearing was held a.t the request of Mr. Paul Hebb for the consideration of a oite develop­ment plan indicating an addition to the florist ohop and land­scaping, pedestrian waHcway and off-street pax 1king :l.rnprovementcJ in the Country Square shopping center. ':::>1.s Q \J�L.l "Fl e: i) 11 lH <,CL. l-:; Mr, Hebb spoke as proponent for the request and oubrn:J.tted el1;1va­tions indicating the appearance of the proposed walkwa.y from the street, He also told the Commis sion that the parking spaces pro ­posed would not cause the removal of the large monkey tail tree on the northeast corner of the site, but that the large cherry tree would have to be removed, Mr. Glaze told the Commission that he felt the improvements pro posed were in the best interest of the Ci·ty and its residori ta a.nd in· order to encourage such improvements, he moved that; /;he plans be approved su qject to the condition that a one inch curb be installed between the proposed off-street parking strip and tho a.lley, Themotion was seconded by Coan and passed unanimously, Jim Wizer (Goodyear Service Center) -A public hearing was held at the request of Mr. Jim Wizer for the consideration of a pro­posed site development plan for the commercial improvement of a Goodyear automobile and appliance center on the northweot corner, of Third and A Avenue. Mr, Mahoney gave the staff report recommending approval of the plans as submitted subject to the recommendations of the Director of Public Woriks, He also showed slides of the site in question. Max Williams, Architect, spoke as proponent for the reques·t. Mrs. Stevenson pointed out that the Commission did not have suffi­cient information as outlined in the Site Development Ordinance and moved to continue the hearing until material submitted meets Section 50,815 of the Lake Oswego Code. The motion was seconded by Schwan. Mr. Williams submitted additional plans to the Commission for their review which indicated certain revisions to the original plans. He also requested that the Commission act on the plans at the March 12th hearing, otherwise the matter might possibly be dropped, Chairman Rohde pointed out that the Staff had not had an oppor­tunity to review the revised plans. Questioh was called for and the motion failed. Planning Commission Minutes March 12, 197:J Mr. Mahoney then advised the Commission that the removal of trees as proposed required a public hearing and that he had failed tohave the matter properly advertised. He then regueoL0d chat the Commission con·tinue the hearing so that proper notic0 could be prepared and advertised, It was moved by Stevenson and seconded that since public notifica­tion was not adequa·te, the public hearing be con·t:L11tt0d. The motion passed unanimously. Mr. Glaze further recommended that the applicant show a reduction of off-street parking spaces from the 24 as proposed to 18 as re­quired by City Code with the balance of the area to be landscaped. The Commission also expressed their desire to see the fir tree on the corner of A and Third saved. Oregon Sup1"eme Court Decision -The Commission asked Mr. Cox to comment on the decision handed down by the Oregon Supreme Court regarding the Fasano Decision, Mr. Cox then advised the Commission of the various implications of the Court's decision. Inco 1 Inc. (Springbook Homes) -A public hearing waa held at the request of Ince, Inc. for the authorization to remove 11 trees for street improvments in the proposed subd:tvision o:f Springb1"ook Homes. It was moved by Schwan and seconded by Glaze to approve the tree removal request within the cul-de-sac area only with the excep­tion of the 16 i11ch maple. The motion passed unanimouGly. SUBDIVISION REVIEW Springbrook Homes -A subdivision review was held at the request of Inca, Inc. for Planning Commission approval of a single family subdivision fronting on Main street. Mr. Mahoney showed slides of the property in question. Mr. DeHaas advised the Commission of the various standards of development required by the Code and recommended conditions of approval. Mr, Harry Krause, Attorney, spoke as proponent for the subdivisioh. Mr. R. w. Kearns, Main street, spoke in opposition to the dedica­tion of an additional 5 feet of right of way on Maih Street since he felt a 4o foot right of way was sufficient. Mr, DeHaas advised the Commission that a 4o foot right of way was not adequate to serve a residential street. It was moved by Schwan and seconded by Glaze to accept the plat subject to the recommendations of the Director of Public Works with the exception of the dedication of art additional 5 1 of right of way. The motion passed with Schenk opposing. Planning Commissi on Minutes -5-March 12, 1973 Lake Oswego Corporation - A public hearing was held at ·the request of the LaJ{e Oswego Corporation for the consideration of a sitedevelopment plan for a marina and boat launching f'ac:Ll:L·ty £:ll":l authorized by the Planning Commission on July 10 1 1972. Ml". Mal1oney gave the staff report recommending approvul of the site plans, and showed slides of the site. Mr. Ed Harvey, owner of Harvey's .Marina, ::;poke in oppoo:lt:Lon to the request stating that there would not be enough bll.u:Lneos to support two marinas. Mrs. Stevenson then moved that all future agendascarry a General Planning section so that general planning matters might be dis­cussed by the Commission and recommendations forwarded t0 the city CoW1cil.
