PLANNING COMMISSION MINUTES JULY 23, 1973
The regular meeting of the Lake Oswego Planning Commission was called to order by Chairman Rohdo at 7:JO p.m. Members present were Joe Glaze, Steve Schenk, Marty Schwan, Ardis Stevenson and Roy Thompson. Staff members present were Bob Mahoney, Planning Director; Gary Bradshaw, City Engineer; Jim Cox 1. City Attorney; Pat Barnum, Planner II and Mindy Kiann, Planning Commission Secretary.
Mr. Schenk asked that the words "and seconded by Schenk", be stricken from the minutes of July 9, 1973 on. Page 4, paragraph 6, line l.
The minutes were approved as corrected.
PUBLIC HEARINGS
Garry McMurry -Staff informed the Commission that Mr. McMurry had withdrawn his application.
Dee Thomason - A public hearing was held at the r.equest 0£ Dee Thomason for a zone change f'rom MR-2 to GC on Lots 4, .5, 10 and 11, Block 6, Oswego and f'rom DR-2.5 to GC on Lot 14, Block J and Lot J, Block 6, Oswego to allow the expansion of' his existing automobile sales f'acility at J09 s. State Street.
Mr. Mahoney read the �taf'f report a.nd s�bmitted the proposed zoning pattern for the Commission's review. He also read letters of' remor.tstrance f1:1om Mr. Wayne Price, ,312 Durham Street and Mrs. Lottie Rogers of 59 Wilbur Street. He then introduced the Old Town Lan d Use study as developed to date and asked that the exhibits be considered as part of the planning information rega.1"ding the applicat:io n.
Mr. Bradshaw gave the report of the Department of Public Works recommending tha.t an LID be formed to improve Church Stre,st from State Streot to Duz•ham and V.iew Cow"'t from State Sh"'aat to Durham, and that the zone change not be effective until the LID is formed.
Mr. G1aze told the Colrtmiss:f,on that it was his feeling that opt:f.ons on the prope�ty did not give Mr. Thomason the right to aot as authorized agent for the zone change and until such doctiments were produced as evidence, the matter should not be considered, Mr. Mahoney told the Commissio n he had seen documents authorizing Mr. Thomason as agent for the request, but that they we�e not a par·b of the zone change f'ile. Mr. Raymond Bagley, attorney for Mr. Thomason, presented the necessary documents.

Mr, Bagley spoke as proponent for the r0quest pointing out 'l:he necessity for 13idewa.lks alo1�g State S·treet, expanded public service for repair of automobiles and .for improved off--street parking.
Mrs. Stevenson asked if the sidewalk improvements and off-street parking improvem.�nts could be accomplished without the benefit of' a zone change, Mr. Cox said they could.
Ms. Pauline Perkins of 717 B Avenue ·told the Comrn:Lrw:1.o.n that she was the owner of Tax Lot 6200 which Mr, Thomason had :included in his plans for Phase II and that she was unaware of any option agreement on the property.
Mr. Ea.rl Schaubel of 208 Durham Street felt the commercial expansion would decrease his property value.
M.r. Ralph Rogers spoke in opposition along with Mr, Wayne P1:•it::0who felt the applicant was already encroaching into public rightof way on State Street and that he should be requirod to constructsidewalks regardless of whether or not he receives a zone change,e
Mr. Bob McGinnis; buyer of Dr. Cottle' s property on. Lobi 1 and 2 o'f Block 6, told the Commission he felt the area was prime resi-• dential property and there'fore he did not want his property to be-come a buffer between commercial and residential properties,
Mr, Art Rossman spoke in favor of' the request,
The public hearing was closed.
Mr. Glaze f'el t the matter was controversial because of :1. ts 1ocut:ion �1�nd because of' the type of' business conducted. He further sta t:t3d that he would be reluctant to grant a zone change in the ar.oa rit:this time because of the current study o'f the Comprehensive C10.t1r:1ral Plan and possible revisions thereto. He thei'i movdd to deriy tht:i zone change request. The mo·tion was seconded by Stevensoh,
Mr. Thompson said he felt the matter should be continued pending the outcome of' the study of the Comprehens:1.ve General Plan.

Mr. Schenk sa1d that since he felt there was no sub13ta.ntial cha.nge in tl1e p.Lans and because the type of' busineoo would no l: generate a great deal of' traffic, he would move to approve tho variance f'rom 14 to 8 parking spaces, and to reduce thc;1 width of the s:l.x parking spaces on the alley by 2 inches each; the 1;;li to development plan and tree cutting application, on tho condition that the applicant support any future LID for off-street parld.1jg and :.tn accordaJ1ce with the recom,iendat.:i.ons of tho J)opartment of Public Works. The motion was seconded by Stevenson and passed unanimously.
Red l'i'ox Hills #J/Edwards I.ndustries - A public hear:Lng was held at the request of Edwards Industi.,ies t'or a tree cutting permit to allow the removal of' tr.ees in the right of way and utility easements in Red Fox Hills #J.
Mr. MaJ1oney gave the staff report recommending approval of tho request.
Mrs. Stevenson asked the staff' why only trees 12 inchos and largo:t' -had been indicated on the application for removal. Mr. Ma.honeyexplained that it was his underste.nding that that was what the Commission had requested of his department in the case of tree re-moval in subdivisions. Mrs. St,�venson told Mr. Mahoney that the Commission wanted all trees 12 inches or largei� ind:J.cated on prelimina,,ry plat.§_ and subsequent tree cutting applications were to meet the requirements for identification as set forth in tho Tree Ordinance. It was further determined that an aerial photo-graph would suffice to identify those trees outside the propooocl �ight of ways where trees are especially plentiful.
Mr. Dave Evans, speaking as proponent for the request, submitted an aerial photograph of the site indicating the dense tree covorage.
Mrs. Steve11son and Mr. Schwan both felt it would be Unfair to continue the hearing pending the completion of' the application since the misunderstanding was between the staff and the Commission.
It was moved by Sohenk to grant aclininist;r,ati·le authority to approve a completed tree cutting application. The motion was seconded by Thompson and passed unanimously,

Westridge Subd3.vision/Hollman Development - A public hearing was held at the reques·t of' Hollman Development for a tree cutting permit to allow tho removal of trees in the road right of way in Phase I of' Westridge Subdivision.
Mr. Mahoney told the Commission that this applicat::J.on had beenhandled the same as the Red Fox Hills //J applicat:Lon :Ln t;hat it only contained information regarding trees ranging f'rom 12 inches.
Mr, Schenk felt the application should be continuod ponding a complete appli cation.
Mr. Mahoney suggested that the Westridge applicat::J.on was similai., to the Red ll'ox Hills application and requested Comm;Loaion consideration, He presented an aerial photograph o� the subdivision for Commis sion review.
Moved by Schenk arid seconded by Schwan to grant administrative authority to approve a completed tree cutting appl:l.cation, Motion passed unanimously.
GENERAL PL.ANNING
Portland-Vancouver Metropolitan Area i990 Public Tr.nnoportation Plan Mr. Bob Kincaid presented an aerial photograph indicating two areas of' undeveloped property in the downtown core area which could be considered for Tri-Met Park and Ridr:l otat:Lons.
Mr, Mahoney told the Commission that CRAG was seeking input from the City as to the location for these facilities within our community.
Mr. Kincaid showed slides illustrating how a park arid ride station might look, costs involved in the program; routes for busses, etc.
Mr, Schenk said he felt the stations, if located within the downtown core area, would cause further traffic congestio n in an already troubled area and would also decrease commercial area, He felt that stations loc ated at the north and south ends of town would be more practical with possibly another along the Bonita Expressway.
It was the general ooncensus of the Commission that a parking lot of this size was not desirable in downtown Lake Oswego, butthey would look with favor on stations located away from the commercial area and away from traffic congestion.
The meeting was adjourned at 11:10 p.m.
