NFIP and E Act
• In order to comply with the federal Endangered Species Act ( ESA), FEMA is
implementing new requirements for the NFIP.
• The new rules will require a Biological Habitat Assessment ( HA) for
development in the Special Flood Hazard Area demonstrating the proposed
development will not reduce or harm critical habitat for endangered
species.
• The FEMA model ordinance establishes criteria for what a HA should
include. These requirements are in addition to the already-established
Floodplain Management Area permits administered by the City in
accordance with the NFIP.
• These new requirements will ensure that all development within the
LA F- floodplain will comply with the ESA.
