The regular meeting of the Council of the City ity cf L kc Oswego convened at 7:35 p.m.
Present were Hermeen, Lawrence, Ross, Stewart and Thomas. Coan absent - Mayor
Stidd, excused, on vacation. Presiding was James E. Lawrence, President of the
Council.
Moved by Thomas, seconded by Stewart that the minutes of the previous meetings be
approved. So ordered.

REQUESTS FROM AUDIENCE
None :
CITY ATTORNEY - L. Eugene Crampton
Opening of bids for local improvement districts. Throe bids were received:
Blyth & Co., net effective rate of 3.4116
Citizens Bank of Oregon, net effective rate of 3.0574
First National Bank of Oregon, net effective. rate of 3.129
It was then movrd by Stewart, seconded by Thomas that the Citizens Bank of Oregon's
bid be accepted. Upon vote, it was so ordered.
At 7:40 p.m., Councilman Coan made his appearance. •
Public Hearing held on L.I.D. No. 59,- Cedar Street. There was one written'remon-
� strance from Mr. Jones, and oral remonstrances by Jess Roe and others. The remon- •
"�_ / strances resulted in 51.5 percent of the foot frontage. Therefore the improvement • ! t
district failed on account of the remonstrances and, according to the-city charter, . ,
cannot be reconsidered for a period of one year. So ordered.
Public Hearing held orS Schukart••Ostoff withdrawal. There were no written remon- ,
strances on file with the Recorder and no oral ones from the floor.
ORDINANCE NO. 768 - AN ORDINANCE WITHDRAWING CERTAIN LANDS HEREIN DESCRIBED FROM
LAKE GROVE FIRE PROTECTION DISTRICT NO. 57, LAKE GROVE WATER DISTRICT NO. 15, FOREST
HIGHLANDS WATER DISTRICT NO. 13, LAKE OSMEGO ZONING DISTRICT NO. 6, LAKE GROVE PARK
DISTRICT NO. • 1, AND AS THE CASE MAY BE, AND DECLARING AN EMERGENCY - reed first .time
in its entirety. Moved by Coan, seconded by Thomas that same be read second time by .

ORDINANCE NO. 771 - AN QRDINANCE.GRANTING A FRANCHISETO ADELINE CROWSON ,DOING . `'
BUSINESS AS OREGON ALARM SYSTEMS TO OPERATE AND MAINTAIN'A BURGLAR AND.HOLDUP ALARM
SYSTEM IN THE CITY AND SETTING FORTH CONDITIONS ACCOMPANYING THE GRANTING OF A
FRANCHISE -• read first time in its entirety. Councilman.Thomas inquired of Mr. Edge
of the Oregon Alarm Systems if they have any other agreements of this nature with
other cities.. The answer was in the negative, but he stated they were in the process
of negotiating with the cities of Milwaukie and Beaverton. Councilman Ross ques-
tioned when the ordinance would become effective? The City Attorney replied after
their written acceptance and compliance of all the provisions of the ordinance. -I ,
Councilman Stewart inquired as to the Telephone Company's cooperation with this com-
pany, and the reply was t e, they wore cooperating 100 percent.

ORDINANCE NO. 772 .. AN ORDINANCE AMENDING ORDINANCE NO. 565, COMOLY KNOWN AS
THE SUBDIVISION ORDINANCE BY AMENDING STREET AND SIDEWALK REQUIREMENTS AND DECLAR-
ING AN EMERGENCY - read first time in it3 entirety. Chairman Bean of the Planning
Commission, after 4.nquiry from the Council as to the Planning Commission's recom-
mendations, stated That it was their unanimous recommendation that this ordinance
be adopted. Councilman Coen raised the question as to the radius of the cul-dejeec.
The answer was that it is a 100-foot circle. Councilman Ross also replied stating
that less than 40 feet would not be acceptable. City Engineer Cruden also supported
this contention of Councilman Ross.
Mr. Warren Mossman asked a question, through the Council, of the Planning Commission
regarding the requirements- for sidewalks and inquired if there was an exception.
Chairman Bean of the Planning Commission replied that this ordinance will bring about
a flexibility as to street width and as to sidewalk requirements. Mr. William Laird
inquired as to the curb requirements. Chairman Bean replied that the requirement as
to curbs has been loft unchanged. This was also verified by the City Attorney who
stated that the curb requirements had not been eliminated by this ordinance.
After discussion, it was moved by Ross, seconded by Coan that Ordinance No. 772 be
read second time by title only. Carried unanimously. ORDINANCE NO. 772 read second
time by title only. Upon roll call vote, unanimously approved.

City Attorney then revested authorization for the Mayor and Recorder to sign a con-
• tract with the Michie City Publishing Company for employment to codify the city or-
dinances. This provic'es for a payment of $2600 during this fiscal'year end $1300
during the next fiscal year. Moved by Thomas,. seconded by Coan that the authoriza-
tion be granted. So ordered. •
Resolution confirming the Recorder's appointment of election board members for the
August 7, 1961 sewer bond election, presented. Moved by Coan, seconded by Stewart ,
that said resolution be adopted. Upon vote, carried unanimously.

Road was presented for Council approval Moved by Stewart, seconded by Hermsen-
that such approval be granted. Carried unanimously.
ORDINANCE NO. 773 - AN ORDINANCE AMENDING ORDINANCE NO. 348•AS MENDED, BY ADDING
THERETO,PROVISIONS COVERING ADDITIONAL YARD REGULATIONS, AND DECLARING AN EMERGENCY-
read first time in its entirety. Moved by Coan, seconded by Thomas that same be
• amended to include the word "basement" and that such basement was not to constitute
a story. After considerable discussion as to whet constitutes a story, or a story
and a half, or two stories, it was moved by Ross, seconded by Stewart that said
ordinance be tabled until the next regular meeting on August let, and that the sub-
ject be referred to the Planning and Development Committee which will make a written •
report to the Council. Upon vote, 'it was so ordered.

At 9:05 p.m. Council recessed for 10 minutes. At 9115 it reconvened.
President of the Council Lcwrence asked regarding the Hughes-Fletcher: Building. .
After considerable discussion about the slowness of the bankruptcy court, it was
moved by Stewart, seconded by Coan that the City Attorney prepare condemnation pro-
ceedings against the aforementioned building. So ordered.
Postmaster Buck read his letter regarding his request for a snorkel mailbox on the
southwest corner of First end "A". This brought forth considerable discussion. Mr.
Walt Relsner spoke in opposition, claiming that this was robbing .the business men
f_ of two parking.epaces for customers. Mr. William Blizzard also. spoke in apposition •
. and pointed out that the present mailbox'does not eliminate any parking space.

Councilman Hermsen questioned the Postmaster in regards to whether the box would
remain in its present location or would be moved to the suggested sorner without .
410 the snorkel feature, if permission was denied. Postmaster Buck an$wez•ed in 'the
affirmative. The President of the Council then suggested that this. subject should
be considered at the next Council meeting when the whole subject of diagonal versus
parallel parking would be on the agenda. Councilman Hermsen stated that this prob-
lem should be decided at this meeting.
It was then moved by Hermsen, seconded by Stewart that the Postmaster's request be
denied. Motion carried unanimously.
ADMINISTRATIVE ASSISTANT - G. D. Gleason
Presented the request of the-Portland General Electric Company to purchase city -
light poles. After discussion, moved by Coan, seconded by Stewart that the.city
accept their offer. Upon vote, the motion carried, with Councilman Ross voting No.

Letter from Mrs. Rogers thanking the City Council for their thoughtflZlness in pre •

senting_her with the framed resolution commemorating ,the services of her late hus- .
band, Councilman Rogers.
Presented the written request from the Chief of Police wherein he asked for per-
mission to call for bide on a new police car. Moved by Ross, seconded by Coan that
said bids be called for locally. Carried unanimously,
Administrative Assistant then presented a request for authorization to purchase a
new chlorinator for the sewage disposal plant at a price not to exceed $1690.
• Councilman Ross suggested that this should be put out on a bid basis. After con-' •
a siderable discussion, it was moved by Coen, seconded by Hermsen that purchase of
a chlorinator be made without bids for an amount not to exceed $1690, with the
approval, by Councilman Stewart, of the unit to be purchased. Upon vote, the motion ,
carried.
Fence for the property purchased from David Myers (Public Works Building).. 'Necessary
to fence this property and, since the cost would be in excess of $500, requested
authorization to call for bids from selected bidders. Moved by Coan, seconded by
Hermsen that such authorization be granted.

CITY ENGINEER - R. N. Cruden
Requested guidance from the Council in regards to a proposed local improvement
district wherein 50 percent of the affected property owners wished to pay the full
cost. Advised that this was permissible.

PARKS - Councilman Hermsen
Councilman Hermsen asked the Council to rescind their previous action of suthorix-_
ing expenditure 'for overhead lights for the tennis courts, stating that the season
was getting late end, with daylight saving time, there is not too Much benefit
that would be derived from the lights this year. It was moved by Hermsen, seconded
by Stewart that such authorization bo rescinded. Upon vote, so ordered. •
SEWER PLANNING & DEVELOPMENT - Councilman Stewart •
No report. '
Councilman Ross made inquiry regarding the letter fxom the City Engineer of the City' .
of Portland. Councilman Stewart replied that he will make no report until after
August 15th. President of the Council Lawrence stated that he would feel better if
' we could negotiate for sewage treatment with Tri-County. Councilman Coan-replied •
that this would be desirable, but such legislation for 'fri-County compulsory authority.

• Councilman Coan presented the Fire Department and Police Department reports and ;
they are made a part of the minutes. Also presented a letter from the Chief of •
Police regarding diagonal parking, which is also made a pert of the record.
Moved by Coan, seconded by Stewart that we accept the reports. So ordered. '
At 10s27 p.m., Councilman Stewart moved that the meeting adjourn. So ordered. .
