Lawrence absent. . Moved by Heimsan, seconded by Thomas that the minutes as mailed arid corrected he accepted. So ordered. TRAFFIC SAFETY COMMITTEE -• Tom i3rouks Introduced Mr. Zink of the Oregon A.A.A. who presented a safety award, for no nodes- tr en deaths during the past two years, to the City of Lake ')swerjo. Lake Oswego was one of thirteen cities in the state to receive this award. Mr. Brooks reported regarding the petition from 39 residents of Cornell Street lee- questing Cornell to be a stop street. This committee recommends that necessary► signs be erected. Request from the Getaway Chevrotet fox 1-hour parking on Leonard Street between State and Church. His committee recommends the xequeet be granted. Mr. Brooks called to the Councils attention the parking condition on "B" Avenue between Second and Third. His committee suggests that parking be allowed only on one side of the block. Chief of Police made the suggestion that parking on the north side should to eliminated. Mr. Brooks then suggested his committee be increased from five to seven members, 41/ and he offered the names of mr. Robert Bradley and Ben F. Walling. Moved by Roes, seconded by He[msen that said names es suggested be confirmed and the committee, enlarged to seven. Upon vote, it was so ordered. Mr. Brooks, commenting upon tho employment of a consulting traffic engineer, stated that the cost to employ such an engineer would be approximately $100 per, day. Therefore, he suggested that the State make as complete and thorough a study as possible, assembling the necesserry date, and then submit it to tho corm• suiting traffic engineer for his study and analysis, thus reducing the cost to 'a - miniiMmn. Mr. Brooks was directed to proceed in this manner. _ • Pape Zone Change! The request for a public hearing, as recommended by the Pl.sniing Commission, was considered, the Mayor stating that this mooting was not for the purpose `of a zone change but to consider the possibility of public hearing as recommended by the Planning CLNrinission. Pete Blyth, attorney for Mr. Pap4z, made his presentation•; Mr. William White, attorney representing Mx. Barron and .there, spoke in opposiiiion, ;' his .opposition being based upon the fact .that said tone change should have been ' initiated.by the usual method of petition instead of by Council action. • Further stated that the Planning Commission recommendation was not arrived at in a fair.`and impartial manner and that there iris nQ showing of public Internet to necassitetc! a public hearing. Mr. White submitted a petition in opposition to said :cone chancie, ,, which represented 42.37 of the area. At 8e14 p.m. Councilman Lowrance made his appearance. • . After lengthy discusaion, the mayor again stated that the decision to he made tonight was rather, a disservice had been done the petitioner by the Council in the past and should they at this time grant him a public hearing? Councilman Lawrence inquired if opposition has appeared at the Planning coetmission. Mr. ® White replied that they sat there for an hour and thirty minutes! and the peti- tioner walked out and no action was taken by .the Planning Commission at that time. At a later meeting the petitioner appeared before the Planning Coramisr-ion, and the Planning Commission gave their recommendation. At 9006 p.m. Thomas moved, Hermsen seconded that a public hearing, to be held, on September 19th, be granted the petitioner oA his proposed zone change. Council- man Lawrence spoke in opposition to the motion and claimed that this was More or less a public hearing. Upon the question being called for,., a %%ell call vote was taken, Lawrence voting No, Ross abstaining. Motion carried by en affirmative vote of three. At 9020 p.m. Council recessed and reconvened at 9*27. CITY ATTORNEY - L. Eugene Crampton Opened the bide for 1962 police car, Ted Gilbert submitting a bid of $2395.00 and Gateway Chevrolet submitting a qualified bid of $2251.49, the qualification being that it was subject to a price change if made by General Motors. Moved by Thomas, seconded by Ross that they accept the Gateway bid. There followed dts- cussion in regards to qualified bids. After the discussion Thomas, with the per- mission of his second, Ross, withdrew the motion. At 9,47 p.m. Councilman Stewart made his appearance. Moved by Thomas, seconded by Ross that both bids be' rejected. Upon the vote„ - those voting No were Stewart, Howson, Lawrence and Ross, Mayor Stidd not voting. 410 Motion failed, After further discussion, moved by Lawrence, seconded by Ihomas that the Gateway qualified bid be accepted with the understanding that such variance shall not exceed 2%. Commenting upon the motion, Councilman Hermsen stated that acceptance of such qualified bid was doing an injustice to the qualified bidder, Upon the question being called, the motion carried, 4ermsen voting No. III COMMUNITY PLANNING 8 DEVELOPMENT - Donald T. Rose' Called to the attention of the Council the: proposed new comprehensive zoning ordinance. After discussion, moved by Ross, seconded by Harmsen that the Planning Commission be directed to hold a public hearing. on said ordinance on the 28th of ' August and that publication of notices of the public hearing be made on Auguat 17th and 24th. Motion carried. • ADMINISTRATIVE ASSISTANT - G. D. Gleason • Called to Council's attention that we have received reimbursement for Marylhurat fire contract. Administrative Assistant requested authorization to spend $3649.17 for the instal- lation of street lights on Pacific Highway from Lake Oswego Creek bridge to Oak Street. Moved by Lawrence, seconded by Thomas that such authorization be grunted. . So ordered. Presented the request for authorisation to' spend $000 for street lights on Leke Bey Court. Moved by Hermsen, seconded by Lawrence such ,euthoxization be granted. • . .. So ordered, r . Roqunsted authorization to accept the easement for the Uplands sewer from the Lake Oswego Country Club, L.I.D. N56. Moved by Lawrence, seconded by Hermsen said easement be accepted by the City. Motion, carried. Administrative Assistant called the attention of the Council to the bill for topping trees on Lake Bay Court. This was not a part of the improvement Oil- trict. He questioned the City's liability for such work, stating that we have ordinances providing for the abutting property to take core of such conditions.: City Engineer explained that, in the pest, the City had been taking care of this problem at the City's expense, and this would be a change in policy. The Coun- cil instructed the Administrative Assistant to study the ordinances and make a recommendation as to policy, but in this instance that the bill should be paid.;. Called to the attention of the Council a new application for the formation of . an improvement district on Cedar Street, stating that the City Charter provides`, that when said improvement district fails by 61% of the foot frontage remonstret- ing against, that no new petition can be considered for a period of a year. ; my ENGINEER - R. N. Cruden ORDINANCE NO. 774 - AN ORDINANCE DISPENSING WITH AN BLECT1ON ON AN ANNEXATION, I AND SETTING A DATE FOR PUBLIC HEARING - read first t`me in its entirety. Moved by Lawrence, seconded by Hermsen that same be read second time by title only. Carried unanimously. ORDINANCE NO, 774 read second time by title only. On roll call vote, unanimously approved. . City Engineer called to the attention of the Council that he had four of the re- quests for annexation, but that he was holding said requests for further study , to see if he ohould apply the 2/3 rule to annex more property then was requested. SPERSONNEL - James F. Lawrence , Stated he would start a job survey in the near future. PARKS - Frank Hermsen Informed Council of the receipt of $100 from the Lake Oswego Garden Club to be., expended for. the Memory Garden. • SEWER PLANNING 8 DEVELOPMENT - Curtis E. Stewart Reports that, on this date, he mot with the City of Portland and discussed things that need to be done and stated that progress is being made in regards to negotia- tions for sewer treatment. . Informed the Council that he recommends the purchase of a Wallace 8 Tiernan chlori- nator, No. A-741, at a cost of $990, end that such equipment will be purchased. Consulting Engineer Darner informed the Council as to his progress and his tenta- tive time schedules ell easements will be prepared by August 25th; on the follow- ing Monday, the 28th, they will start preparing drawings and specifications; Thursday the 17th, the County crew would be at work with their electronic survey- ing instrument; by September 15th, he will submit his drawings to the State Sani- tary Authority for approval. During the discussion it was brought out that the City's engineering force would also have to be expanded, and it was therefore moved by Stewart, seconded by Hermsen that the Administrative Assistant be instruc- ted to obtain adequate facilities for the engineers and to increase their staff as required so that there would be no delay in the normal city engineering work' and in the construction of the $1.,250,000 interceptor sower plus a feasibility study for the fornmticcn cf tooai improvement districts to connect to .laid inter- -`1 captor, costs to be charged to the bond issue in a Gum not to exco9d S50,000.00 Upon the motion being called for, staid motion carried unanimously. FINANCE - George Thomas Informed the Council that a supplemental budget would have to be prepared. PUBLIC SAFETY •• Mayor Stidd r ' Fire Chief submitted a written request for authorization to advertise for bids for a new fire engine on a rental purohese beats. Moved by Lawrence, seconded - • by Hermsen said authorization ba granted. So ordered. The Mayor presented the monthly police and fire reports. 531d reports are made a part of the official minutes. • Moved by Lawrence, seconded by Hermsen that the attorney be instructed to pre- pare pare a resolution making Oak Street one way from McVey to Cordell. So ordered. At llsla p.m., there being no further business, Thomas moved that the meeting adjourn.
