Stewart absent on account cf illness. - Moved by Lawrence, seconded by Hermsen that the minutes of the previous meeting, as mailed, be approved. Carried unanimously. REQUESTS FROM AUDIENCE . 11 Mr. James Martin, a builder, inquired regarding the water policy on property out- side the city limits. Referred to Councilman Coan to explain the water policy to Mr. Martin later in the evening. .. CITY ATTORNEY - L. Eugene Crampton Renewal of Class B package liquor license for Remsen's Grocery. Moved by Coan, seconded by Lawrence that Council grant the approval. Carried unanimously. , ORDINANCE NO. 790 - AN ORDINANCE AMENDING ORDINANCE NO.' 789 KNOWN AS THE SIGN ORDI- NANCE BY PROVIDING FOR VARIANCES IN CERTAIN CASES AN_D,.DECLARING AN EMERGENCY - read first time in its entirety. After the reading, the Mayor explained to the audience', . the intent of the ordinance, namely to correct a particular problem, that of Mr.- Faus. It was then moved by Ross, seconded by Coan that it be read again for the second time in its entirety. Carried unanimously. ORDINANCE NO. 790 read second time in its entirety. Mayor then inquired of the Attorney if it was proper to in- ® terpret this ordinance in the following manner - i.e.; that if a merchant had a present contract and moved, that ho would have the right of appeal. The ettorney's reply was in the affirmative. It was then moved :by Coan, seconded by Lawrence that .. the ordinance be adopted. Upon roll call vote, carried unanimously. The request of Mr. Feus was then presented for a variance. It was then moved by Lawrence, seconded by Coan that the two signs, the roof sign and the one on the front of the building, be. allowed to be moved. The request for signs in the alley to be denied as, by ordinance, businesses arernot allowed in the alleys. Carried unanimously. Councilman Lawrence then reported on his attendance at the Civilian Defense Confer- 'ence held at Salem, stating that the federal government has embarked on a new ahel- ter program; that private consulting engineers will evaluate all structures within the City, with the owners' 'consent. It was then moved'by Lawrence, seconded'by Ross that a letter be sent to Clark and Drouth,.:consulting.engineers, Salem, Oregon,,} • making City facilities available to them for the purpose of conducting .this survey. Tidewater notified they were the successful -bidder for gas and Stein- Tidewater for oil. Continuation of public hoaring on LCD "E" Avenue. ® The Finance Committee recommended to the Council the following: , (1) That the City does benefit from the improvement of this street and that the City should participate to the extent of 25%. (2) That instead of applying the rule for benefits on a foot frontage basis, that the rule for benefits should be applied upon en area basis. Mrs. Yost again objected to the assessment hut, after further explanation, finally agreed that it was a fair appo:'tiorment of the costs. Mrs. Relict remonstrated, claiming that she is also entit).ed to a retaining wall hut, after the City Engineer's explanation, stated that she is not too upset. Mr. I.imeratos remonstrated, claim- ing general damage and loss of shrubs for which he has not been compensated. (8,40 p.m.) Discussion was limited to the Council. • (8:44 p.m.) ORDINANCE NO. 787 - AN ORDINANCE LEVYING ASSESSMENTS FOR THE •IMPROVE- MENT OF "E" AVENUE BETWEEN STATE STREET AND FIRST STREET BY GRADING, GRAVELING AND PAVING, WITHIN THE CITY OF LAKE OSWEGO, DESCRIBED AS IMPROVEMENT DISTRICT NO. 25, AND DIRECTING THAT SUCH ASSESSMENTS BE ENTERED IN TNE DOCKET OF CITY LIENS - read first time in its entirety. ?loved by Lawrence, seconded by Coen that it be read second time by title only. Carried unanimously. ORDINANCE NO. 787 read second time by title only. Mrs. Roller now stated for the purpose of the record that she is not at all happy about her assessment. . Mrs. Yost wants the record to ® show that she does not have a curb. Mr. i.imeratos wants the record to show that he is taking this up with his attorney. At 9:O9 p.m., upon roll call vote, ordinance No. 787 unanimously approved. At this time a ten-minute recess was ordered. At 9:29 p.m. Council reconvened. Warren-Howard Company request for street vacation Pine Street from Cornell to Bickner. Petitioners, represented by their attorney, Paul Van Bergen, requested the Council to initiate the action to vacate Pine Street, stating that the Planning Commission has given tentative approval of their preliminary plat, subject to the vacation of the street. Stated the reason for the vacation was to take full advantage of the natural contour of the land. Councilman Coen stated that, without the 'consent of two lots, the two lots would he landlocked and that he would have to oppose'-their request. The petitioners stated that they had been attempting to contact Mr. McDanieis by letter to see how he feels in regards to the situation, but have been unable to obtain a reply. Councilman Lawrence thinks that the consent of the abutting property owners should be obtained prior to any Council action. Administrative Assistant celled to the Council's attention that, under th&s proce- dure, the City would have to bear all the cost of clerical work and title search, whereas, under the other procedure, the subdivider would bear all the expense. The petitioners stated that they would be glad to. stand the City's expense if vaca- tion initiated by Council action. It was then moved by Thomas, seconded by Hermsen that the Council initiate the vacating of Pine Street subject to the subdivider reimbursing the City for all the costs involved. After further discussioni' Council- men Thomas offered to withdraw his ,notion. This was agreed to by the second, Councilman Hermsen. They suggested to the subdivider that he renew his request at the January 2nd meeting. -2- • .• A le 1 40 .the Admioistrati'✓e Assistant presented cornmunication from Elmore Itoecker in re- gards to 4-way stop at; Bryant Road -• Lakeview Boulevard. The Meyer referred to the Traffic Committee. Thb Administrative Assistant suggested that the Council might give consideration to the fact that our engineering departmant has a terrific work load torkepare their feasibility study and the local improvement districts for the lake inter- ceptor sower. Due to this reason, he suggested that our engineering department place all other local improvement districts at the foot of the priority list end that the engineers should not act as engineers for subdividers except in extra- ,, ordinary instances. After discussion, it was moved by Coon, seconded by Hermsen that such recommendation be approved. So ordered. Also called to the attention of the Council that street lights from Lake Oswego Creek bridge to Oak Street on the State Highway had been installed. CITY ENGINEER -• R. N. Cruden LID #63. This LID strictly a subdivision project. Moved by Ross, seconded by Coan that the City Engineer and Recorder be instructed to take no further action on LID #63. Carried unanimously. LID ##64. The original petition requesting the formation of this LID purported to be by the request of 100 per cent of the property owners affected. This was in error. Therefore, moved by Ross, seconded by Coan that the City Engineer and Recorder be instructed to take no further action on this LID. LID #t65 (Greentree Sewer) - Resolution No. 1, forming district by Council action. Moved by Lawrence, seconded by Ross that said resolution be adopted. Carried . unanimously. City Engineer presented the offer from the Oregon-Portland Cement Company to level the sewage disposal plant property at no charge to the City if they can have the dirt and rock and the use of the City truck and personnel not otherwise used; ;:, this for the right to use the dirt removed. After discussion, moved by Hermsen, seconded by Coan this`be authorized. Amended by Ross, seconded by Lawrence that City equipment be made available only at the discretion of the Superintendent of Public Works and that, in addition thereto, the Oregon-Portland Cement Company are to be liable for any damages caused to City equipment. On vote, the amendment carried unanimously. Motion, as amended, then carried unanimously. Foothills Road. Estimated cost $179,075.00, of which $68,650.00 represents the estimated cost of acquiring land. City Engineer requested an informal meeting of the property owners affected some time between Christmas end New Years to determine if they wish to proceed. PERSONNEL Councilman Lawrence Moved by Lawrence, seconded by Coan that Officer Harris, with Officer McCarthy as his alternate, be appointed to the Employees Representation Committee. Carried unanimously. Moved by Lawrence, seconded by Thomas that the action of the Chief of Police and the Personnel Committee in the discharge of Officer Kennard December 11th be con- firmed, Carried unanimously. 411 FINANCE COMMITTEE - Councilman Thomas Moved by Thomas, seconded by Lawrence that the November expenditures in the amount of $785,015.24, as shown by the recap which is attached, be approved for payment. Upon roll call vote, carried unanimously. -3- • PARES - Councilman Hempen • Submitted the request of tho Lake Oswego High' School for use of the tennis courts .. from March 'Sth to May 15th from the hours of 3100 p.m. and 5130 Om., Monday through . Friday. Said use authorized. Carried unanimously. y 0• COMMUNITY PLANNING & DEVELOPMENT - Councilman Ross None Councilman Lawrence called the attention of the Council to the installation of a police alarm in the communications center without. the permission of US Council. _> After discussion as to the Council's policy and in answer to a question whether • such a service should be on a franchise basis versus a business license, the . attorney' replied this can't he handled in any other .way then ona' franchise basis.
