PLAN DESCRIPTION: 120-DAY DECISION DATE: R-7.5 N/A' ZONING DESIGNATION: NEIGHBORHOOD ASSOCIATION: R-7.5 Evergreen APPLICANT'S REQUEST Per Condition G of LU 09-0029, the applicant is requesting a formal review of the Traffic Monitoring and Management Plan (Traffic Plan) for the Our Lady of the Lake's (OLL) Conditional Use Permit(CUP) of a K-8 school with 320 students, a new Parish Center, parking lot, and playfield. A formal review by the Development Review Commission (DRC) is required each year for three consecutive years following the first academic year that the school has been in operation in the new Parish Center.This is the third and final annual review.The purpose of the review is to determine if the Traffic Plan is meeting the requirements as outlined in Condition G in the approved initial Findings, Conclusion, and Order per LU 09-0029 (Exhibit F3), as modified per LU 13-0003 (Exhibit F4), and as modified per LU 14-0008(Exhibit F5). 1 The applicant's request is a formal review of conditions of approval imposed by prior approval and is not a new Major Development application. As such, it is not subject to the 120-day decision rule. LU 14-0073 Page 1 of 8 II. RECOMMENDATION Find that, as conditioned,the applicant is in compliance with the CUP as approved in LU 09-0029 and as modified per LU 13-0003 and LU 14-0008. III. APPLICABLE REGULATIONS A. Prior Approvals Under Review: LU 09-0029 (initial DR and CUP approvals) LU 13-0003 (First Annual CUP Review) LU 14-0008(Second Annual CUP Review) IV. FINDINGS A. Backeround/Existine Conditions: 1. The site is approximately 4.13 acres in area (Exhibit El), and is located on A Avenue (major arterial). The site also has frontage on Evergreen Road and 8th Street, both local streets. The site incorporates the vacated portion of 7th Street between A Avenue and Evergreen Road. The eastern property line abuts a 20-foot wide alley. 2. OLL is one of the older parishes in the region. Since initial development, the site has included a church, a school with an outdoor play area,a convent, parish offices, single family dwellings for church officials, and a large on-site parking lot. 3. In 2009, a CUP and Development Review(DR) Permit were approved (LU 09-0029)which allowed: • A CUP for a K-8 school with 320 students; • A DR Permit to construct a 56,249-sq.ft. Parish Center to house the offices and school; • Construction of a 132-space parking lot, playfield, and play structure; and, • Removal of 30 trees to accommodate site development activities. 2 Chapter 50 of the Lake Oswego Code was reorganized and renumbered effective April 19, 2012. The quoted conditions of approval from the DRC Findings,Conclusion,and Order for LU 09-0029 reference the old version of Chapter 50 but the staff findings will reference the current code. Both versions of Chapter 50 are available at: htto://www.codeou blishine.com/OR/La ke0sweeo/htm I2/LakeOsweeo50X/LakeOsweeo5oX.html 3 Condition G(1)(b)and(c) imposed the neighborhood meeting and notice provisions required to be met. 4 Condition G(1)authorized the additional conditions of approval if the Traffic Plan is found to not meet the minimum requirements of Condition G(2). s Condition G imposed the requirement for DRC review. LU 14-0073 Page 2 of 8 No changes to the existing church facility were proposed with that application. To accommodate the redevelopment, both of the single family dwellings were demolished, as well as the convent, parish offices, and original school. 4. The site is zoned R-7.5 and developed with the Parish Center,the church, parking lot, and playground area. The adjacent properties to the north across A Avenue are zoned R-6 and are developed with single family dwellings. Adjacent properties to the south across Evergreen Road and west across 8th Street are zoned R-7.5 and developed with single family dwellings. The abutting properties to the east are zoned R-7.5 and EC and are developed with single family dwellings and as a commercial property. 5. The Findings, Conclusion, and Order(FC&O)for LU 09-0029 were adopted on December, 21, 2009, and included a formal review of the Traffic Plan each year for three consecutive years(Exhibit F3). The first annual review was conducted in 2013 (LU 13-0003) and the FC&O were adopted on May 6, 2013 (Exhibit F4). The second annual review was conducted in 2014(LU 14-0008) and the FC&O were adopted on March 17, 2014 (Exhibit F5). This is the third and final annual review. 6. During the first annual review in 2012,the DRC determined that Condition G(2)(c) should be modified to clarify that the intent of the condition is to measure traffic impacts from all school-related trips on the surrounding residential neighborhood (Exhibit F4). The DRC also determined that an additional condition of approval should be imposed to require the applicant to complete outreach to parents to discourage the use of Evergreen Road for pick-up and drop-off of students(Exhibit F4). 7. During the second annual review in 2014,the DRC determined that the required outreach to OLL parents discouraging the use of Evergreen Road was very effective and imposed a condition of approval to require outreach efforts at the beginning of each academic year from that point forward (Exhibit F5). V. PUBLIC NOTICE OF APPLICATION AND APPLICANT'S BURDEN OF PROOF A. Neighborhood Meeting: A neighborhood meeting is not generally required for a formal review of conditions of approval; however, Condition G of LU 09-0029 requires the applicant to meet with the neighborhood prior to submitting for each annual review and file a copy of neighborhood meeting minutes with the application. The applicant held a neighborhood meeting on December 4, 2014. The minutes of that meeting is attached as Exhibit F6. B. Public Notice to Surrounding Area: Per Condition G of LU 09-0029,the formal review before the DRC shall be subject to the same notice provisions as the initial CUP and other major developments (LOC 50.07.005.6 and LOC 50.07.003.3.e). The City has provided adequate public notice and opportunity to comment on this application. One comment in support of the application was received from the Evergreen Neighborhood Association, Exhibit G100. LU 14-0073 Page 3 of 8 C. Burden of Proof: LU 09-0029, Condition G, requires this review to determine if the Traffic Plan parameters and the additional conditions imposed by the DRC are being met. The applicant has provided sufficient evidence to enable staff to determine compliance. These documents are listed as exhibits at the end this report. VI. REVIEW OF CONDITION G (LU 09-00291.CONDITION Bill(LU 13-00031.&CONDITION Bill(LU 14-00081 The applicant is required to file a request for formal review of the Traffic Plan each year for three consecutive years(Exhibit F3). The scope of the formal review is limited to the determination of whether or not Condition G, and subsequent conditions per LU 13-0003 and LU 14-0008, are being met. It is not a re-review of the CUP criteria or the development review application. The following is an analysis of compliance with Conditions of Approval G(1)-(4), as well as Condition B(1) per LU 13-0003 and Condition B(1) per LU 14-0008: G. Within Six(6)Months of Starting the 1st Academic Year in the New Parish Center. the Aoalicant/Owner Shall File the First of Three Annual Requests for Formal Review of the K-8 School Traffic Monitoring and Manaaement Plan(Plan)by the Development Review Commission(DRCI: 1. The formal review process shall consist of the following elements: a. The review shall occur annually for three years beginning six(6)months after starting the first academic year in the Parish Center. A final review shall also occur when the school reaches full capacity of 320 students. Classes began in the new Parish Center in September, 2012. The applicant filed the request for the first annual review on January 31, 2013 (Exhibit F4). The request for the second annual review was filed on January 21, 2014(Exhibit F5). The request for the third and final annual review was filed on December 15, 2014 (Exhibit Fl). Staff finds that the applicant has complied with the first part of this condition with this final annual review. Per this condition, a final review will be necessary by the applicant when full capacity of 320 students is reached. b. Within 60 days prior to filing a request for the annual review, the applicant shall hold a neighborhood meeting to solicit input on the Plan, consistent with Condition G(2), below. Minutes of this meeting shall be submitted with the request. The applicant held a neighborhood meeting on December 4, 2014, and the meeting minutes are attached as Exhibit F6. The applicant then filed the formal review request of the Traffic Plan on December 15, 2014, which is less than 60 days after the date of the neighborhood meeting(Exhibit F1). Staff finds that the applicant has complied with this condition. c. The review shall be subject to the requirements of LOC 50.69.030, including the notice provisions of LOC 5O.69.030(3)(b)and LOC 50.82.020(1). As noted earlier, the Community Development Code(LOC Chapter 50) was reorganized but the noticing provisions remain the same. The code section LOC 50.69.030(3)(b) is now under LOC 50.07.005.6. Notice of the DRC public hearing was mailed to the public and also posted on the site no later than 10 days prior to the hearing. Staff finds that the applicant has complied with this condition. LU 14-0073 Page 4 of 8 d. If the DRC finds that Condition G(2),below, is not met, it shall impose additional conditions of approval to assure compliance. The applicant has provided sufficient material to determine whether or not the conditions of approval have been met (Exhibits E1-E-3 and F1-F7). As discussed in the applicant's narrative (Exhibit Fl) and staff findings, below, conditions of approval have been met. 2. At a minimum, the Plan shall demonstrate the following: a. No consistent backup on 8th Street due to ingress or egress from the project parking lot. The applicant states that no consistent backup on 8th Street was found during school drop-off and pick-up times (Exhibits Fl and F2). On-site queuing and circulation is proceeding according to the traffic circulation plan approved per LU 09-0029(Exhibits E2 and F2). Staff finds that with efficient on- site traffic management, as well as the initial improvements to increase the right turn lane storage length on 8th Street, there are no queuing problems on 8th Street due to ingress and egress to the site. Staff finds that the applicant has complied with this condition. b. No consistent backup at the 8th Street and A Avenue intersection. The applicant states that the queuing analyses performed in 2009 (per LU 09-0029), 2012, 2013, and 2014 demonstrate that the project has not significantly affected backup at the A Avenue and 8h Street intersection (Exhibits Fl and F2). The Engineering staff has reviewed the queuing analysis worksheets and concurs with the applicant's findings and conclusion. Staff finds that the applicant has complied with this condition. c. Cut-through School-related traffic on Evergreen Road project shall not increase more than 20%as measured against the base count provided for by Condition 8(16)and as adjusted in Exhibit E-6 of LU 13-0003. As noted, above, this condition of approval was modified per LU 13-0003 to clarify the definition of "cut through traffic" to reflect all school-related traffic(Exhibit F4). The DRC also approved an amendment to the 2010 base traffic count that measured all "school-related" trips that used Evergreen Road prior to redevelopment of the site (Exhibit F4), (Modified condition language is shown with strikeNxsagh and underline). The applicant completed a traffic count for this annual review and found the following(Exhibits Fl and E3): School-Related Trips Utilizing Evergreen Road 2010 Amended Base Count+ 2012 Count Base Count 20% (LU 13-0003) 2013 Count 2014 Count AM 17 21 F 28 16 16 F PM 14 17 22 14 14 F Total 31 38 F 50 30 30 F The 2014 count demonstrates that the number of school-related trips that use Evergreen Road is lower than pre-development 2010 amended base count levels. Staff finds that the applicant has complied with this condition of approval. LU 14-0073 Page 5 of 8 3. The traffic monitoring shall be conducted in October of each year,in the same manner as established in Condition 8(16), above, to the satisfaction of the City Traffic Engineer. Data collection was completed on October 21, 2014, at the same data collection points used for the earlier traffic counts(Exhibits E3 and F1-F2). Staff finds that applicant has complied with this condition. 4. Nothing in this Condition G shall be construed to prohibit earlier review and additional corrective measures if warranted by LOC 50.69.030. Staff finds that the scheduled annual review was sufficient to determine compliance with the Traffic Plan and that earlier review was not necessary. Staff finds that the applicant has complied with Conditions G(1)-(4) per LU 09-0029 and that no additional corrective measures are warranted with this application. During the first annual review in 2012, the DRC found it necessary to impose an additional corrective measure [Exhibit F4, LU 13-0003 Condition of Approval B(1)] to ensure minimal school-related trips on Evergreen Road: B. Within One Month of the Date this Approval, the Applicant/Owner Shall: 1. Prepare(in cooperation with the City Engineer)and mail a letter to all OLL parents that specifically discusses minimizing traffic impacts on Evergreen Road by diverting all drop- off and pick-up traffic to the A Avenue and 8th Street intersection. The second annual review demonstrated that OLL had complied with this condition and mailed an outreach letter to OLL parents. Staff has previously found that Condition B(1) per LU 13-0003 was met (Exhibit F5). During the second annual review, the DRC also found that because outreach to OLL parents was effective in reducing the number of school-related trips on Evergreen Road,the applicant should be required as a condition of approval to send out the letter each academic year[Exhibit FS, LU 14-0008 Condition of Approval B(1)]: B. At the Beginning of Each Academic School Year. the Applicant/Owner Shall: 1. Prepare and mail a letter to all OLL parents that specifically discusses minimizing traffic impacts on Evergreen Road by diverting all drop-off and pick-up traffic to the A Avenue and 8th Street intersection. The applicant mailed the annual letter to OLL parents for the 2014/2015 academic year on August 12, 2014(Exhibit F7). The applicant also states that OLL will continue to mail the letter to parents at the beginning of each year(Exhibit F1). Staff finds that the applicant continues to comply with LU 14-0008 Condition B(1). VII. CONCLUSION Based upon the information provided by the applicant and available to staff, staff concludes that Condition G for LU 09-0029, Condition B(1) for LU 13-0003, and Condition B(1)for LU 14-0008 have been met by the applicant. LU 14-0073 Page 6 of 8 VIII. RECOMMENDATION Staff recommends that the DRC accept staff findings. Staff notes that even though the applicant has complied with the requirement for three annual reviews (LU 09-0029, modified by LU 13-0003 and LU 14-0008), the applicant is required to continue to comply with the conditions of approval. Further, per Condition G(1)(A)of LU 09-0029, the applicant is required to notify staff and undertake a final DRC review when the school reaches full capacity of 320 students. EXHIBITS: A. Site circulation observations identify efficient, orderly drop-off and pick-up operations during peak hours. No consistent queuing was observed on 8th Street due to ingress or egress from the project parking lot or at the 8th Street/A Avenue intersection. Queuing analysis at the study intersections along 8th Street was compared to the 2009 queuing analysis performed during the permitting of the school expansion,as well as the 2012 and 2013 traffic monitoring study.SimTraffic software was used assuming a 25-foot queue storage length and Oregon Department of Transportation analysis methodologies. Queuing analysis presented in the previous table indicates the project has not significantly affected queuing,and there is adequate queue storage at the study area intersections. Overall,the student pick-up process effectively meters vehicles departing the site, and vehicles do not cause excessive queuing on the adjacent roadway network. Any vehicle trip which was positively identified as using both the 8th Street/Evergreen Road intersection and school access onto 8th Street was defined as a"school-related"trip. Previous Trip Studies and Outcomes The 2010 base count identified 17 vehicles during the AM peak hour and 14 vehicles during the PM peak hour as school- related trips using Evergreen Road. The 2012 traffic monitoring study identified 28 vehicles during the AM peak hour and 22 vehicles during the PM peak hour resulting in non-compliance with condition G(2)c. Following the 20% increase in 2012, suggestions to mitigate school trip impacts were considered based on Evergreen Neighborhood Association,City staff,and Our Lady of the Lake input. The chosen mitigation method was increased communication and education from the school to the parents. This resulted in a letter as required by condition B(1) of LU 13-003 which states, "Prepare (in cooperation with the City Engineer) and mail a letter to all OLL parents that specifically discusses minimizing traffic impacts on Evergreen Road by diverting all drop-off and pick-up traffic to the A Avenue and 8th Street intersection." A copy of the letter is included in the appendix. In addition to the letter, increased communication and reminders were, and continue to be, part of other school events and school-parent interactions,such as Back to School Night and the welcome packets for new families. The 2013 traffic monitoring study identified 16 vehicles during the AM peak hour and 14 vehicles during the PM peak hour as school-related trips using Evergreen Road resulting in compliance with condition G(2)c. 2014 Trip Study The 2014 traffic monitoring study identified 16 vehicles during the AM peak hour and 14 vehicles during the PM peak hour as school-related trips using Evergreen Road resulting in continued compliance with condition G(2)c. The following table shows the results of the current and previous trip studies side-by-side. Condition G(2)c,which states no more than a 20% increase in school-related traffic on Evergreen Road is allowed,is met following successful mitigation. Current counts indicate a reduction in school-related trips compared to previous counts. Our Lady of the Lake will continue their effort in increased communication and educational efforts by the Our Lady of the Lake School continue to be incorporated into their year-round routine as indicated in the attached letter. Prior Approvals: 3 4 Conditional Use permit[CU 1-80] for a 2-story expansion to the existing K-8 school building 5 6 CONCLUSION 7 8 The Development Review Commission concludes that LU 09-0029 can be made to comply with all 9 applicable criteria by the application of certain conditions. 10 It FINDINGS AND REASONS 12 13 The Commission incorporates the November 25,2009, Staff Report,(with all exhibits attached thereto), 14 as support for its decision supplemented by the further findings and conclusion set forth herein. In the 15 event of any inconsistency between the supplementary matter herein and the staff report,the matter herein 16 controls. To the extent they are consistent with the approval granted herein,the Commission adopts by 17 reference its oral deliberations on this matter. 18 19 Following are the supplementary findings and conclusions of this Commission: 20 21 1. The Commission received oral and written testimony from citizens, both proponents of the 22 proposal and those who were opposed to various aspects of it. Testimony from concerned citizens 23 focused on the traffic circulation plan,design and massing of the structure, proposed yard 24 setbacks,deconstruction, buffering dissimilar uses,vision clearance at the north 8`h Street 25 driveway,the location and size of the proposed parking lot, future development plans of the site, 26 and the perceived bias in the applicant's traffic impact analysis. 27 28 Traffic Circulation 29 Many of the neighbors testified that the site plan(with a new driveway on 8a' Street and a 30 proposed circulation plan that includes ingress and egress from 8th Street)was not a good design 31 and would negatively impact the surrounding neighborhood. Concern was focused on two areas: 32 1)That the plan would double the traffic on 8`h Street. Testimony pointed out that the current 33 traffic circulation plan utilizes access to the site from A Avenue by way of the alley. The 34 proposed plan would require parents to use the existing and new driveway on 8th Street and 35 includes improvements to the intersection to improve traffic flow. 2)Neighbors testified that 36 parents would cut through the neighborhood to avoid the signal at 8th Street and A Avenue. There 37 was a strong concern that the parents dropping off students could easily bypass the intersection, 38 adding to the traffic burden throughout the neighborhood. 39 40 The applicant and proponents testified that the school does an adequate job at enforcing the 41 current circulation plan. Each fall, parents receive a letter with the circulation plan attached and 42 are notified personally if there is an issue with compliance. The applicant also stressed that many 43 families have multiple students in attendance that would allow for carpooling,thereby reducing 44 the overall traffic impact. 45 46 The Commission agrees with the neighbors that traffic was of primary concern and that the burden 47 of compliance was on the applicant, especially as this proposal is for a conditional use. The 48 Commission finds that the applicant has provided an internal traffic circulation plan that would 49 regulate the release of cars onto 8th Street, enforced by school and parish officials. By enforcing 50 this plan,with an additional condition of approval,the Commission finds that the traffic impacts 51 can be addressed formally, in a timely manner,and with the possibility of mitigating any 52 unforeseen impacts. LU 09-0029-1714 Page 3 of 13 1 2 3 Design and Massing 4 Generally,citizens supported the design of the Parish Center. The applicant noted that the Code 5 required"complementary"building design, not identical. The contemporary design of the school 6 was proposed to be unique, add to the overall variety of attractive architectural styles within the 7 City,and enhance the streetscape along A Avenue. Overall, the proposal only nominally 8 increased total lot coverage on the site by approximately 67 square feet. 9 10 There was testimony regarding future development plans on the site. The applicant testified that 11 there was no plan for a separate parish building at this time;the open space proposed between the 12 church and Parish Center was to remain as a landscaping amenity. A number of neighbors also 13 questioned the proposed yard setbacks,stating that A Avenue should have a 25-foot setback,not a 14 12.5-foot setback. Staff clarified that the site has three frontages(and therefore three front yards) 15 with only one yard required to be the full 25 feet. The applicant proposed to provide the full 25 16 feet on the Evergreen Road frontage to allow for a larger landscape buffer where the parking lot 17 abutting the residential neighborhood is located. 18 19 The Commission finds that the overall design was thoughtful and well done in relation to the 20 criteria. It also finds that the Commission's decision is limited to the proposal presented in the 21 application,not future potential development requests. The Commission finds the yard setbacks 22 work,as the structure was only one-story along A Avenue and the greater yard setback along 23 Evergreen Road provided separation between dissimilar uses (parking lot and residential 24 neighborhood). 25 26 Deconstruction 27 The Commission received testimony requesting that the applicant be required to "deconstruct"the 28 existing buildings as a condition of approval. The applicant has indicated an interest in 29 deconstruction, providing that it works within the constraints of time and funding. 30 31 The Commission finds that it cannot impose this requirement as a condition of approval as it is 32 not related to the code-based approval criteria or compliance standards. 33 34 Vision Clearance 35 The north driveway entrance on 8th Street abuts angled parking along the eastern edge of the right 36 of way. The driveway will be widened and re-graded. The City Engineer reviewed the sight 37 distances and found that the proposal complies with the vision clearance standards in either 38 direction. 39 40 The Commission finds that,as conditioned to comply with vision clearance standards at the time 41 of building permit application,the proposal meets the criteria. 42 43 Parking Lot 44 The Commission received testimony that there were too many parking spaces and that the parking 45 lot created too much impervious surface on the site. In addition, a neighbor testified that the 46 parking lot buffer along 8`h Street was too narrow. The applicant proposed 132 parking spaces. 47 Staff recommended a condition of approval to remove two parking spaces to increase the width of 48 a landscape island; as modified,the parking lot will have 130 parking spaces. 49 50 The applicant testified that the number of parking spaces required by code was reduced through a 51 shared parking study. Without the shared parking study that demonstrated the church and school LU 09-0029-1714 Page 4 of 13 I uses have different peak hours,the required parking would have been a minimum of 212 parking 2 spaces. 3 4 The Commission finds that with regards to the narrow landscape buffer along 8`h Street,the 5 applicant is proposing to drop the elevation of the parking lot below the street level with a 6 retaining wall. With the change in elevation and with the proposed landscaping,the buffering is 7 sufficient. The Commission also finds that,through the use of shared parking,the proposal meets 8 the required parking requirements and allows for a smaller than standard parking lot. 9 10 Traffic Impact Analysis 11 A neighbor testified that the traffic impact analysis was biased because it was produced by the 12 applicant's land use consultant's in-house traffic engineers,and that it contained errors such as a 13 stop sign where there was not a sign. The applicant clarified that the City has set the parameters 14 for the traffic study and that the City's Traffic Engineer has reviewed the analysis and plan,and 15 had imposed additional conditions of approval to improve the 8'h Street and A Avenue 16 intersection. 17 18 The Commission finds no bias from the results of the traffic impact analysis,that the errors found 19 did not compromise the integrity of the analysis,and that with the additional conditions of 20 approval to improve the intersection and to monitor the traffic, the traffic impact analysis is 21 sufficient to determine compliance with applicable criteria. 22 23 2. The Commission also adopts the clarifications and corrections to the staff recommended 24 conditions of approval outlined in the applicant's memo,dated December 4,2009 (Exhibit F-17), 25 which have been incorporated in the conditions below. 26 27 ORDER 28 29 IT IS ORDERED BY THE DEVELOPMENT REVIEW COMMISSION of the City of Lake Oswego 30 that: 31 32 1. LU 09-0029 is approved, subject to compliance with the conditions of approval set forth in Subsection 33 2 of this Order. 34 35 2. The conditions for LU 09-0029 are as follows: 36 37 A. Approval of LU 09-0029 shall be valid for a 3-year period from date of the Order 38 granting final approval of this project,and shall be void if construction is not complete 39 within that time period, 40 41 B, Prior to Issuance of any Building Permits,the Applicant/Owner shall: 42 43 1. Apply for a Demolition Permit for the existing parish office structure,detached 44 dwellings, and parking lot on site. The applicant shall note that this may require an 45 asbestos report from a licensed agency to the satisfaction of the Building Official. 46 The Demolition Permit shall be accompanied by an application for a Tree Protection 47 Permit. 48 49 2. Submit final site and building plans for review and approval of staff that are the same 50 or substantially similar to the site plan, floor plans, and building elevations illustrated 51 on Exhibits E5, E12,E13, E16-E17,E25-E32,to the satisfaction of staff,except as 52 modified, below: LU 09-0029-1714 Page 5 of 13 1 2 a. The second floor plan of the Parish Center shall be modified so that all parish- 3 related office space has a setback equal to or greater than 36.7 feet from the east 4 property line abutting the alley. 5 6 b. Illustrate the location of six additional bike racks,for a total of 24 bike racks. 7 The racks may be clustered in one location as long as each space is a minimum of 8 six feet long and two feet wide. The bike racks shall be of a material or painted to 9 complement the building. 10 11 c. The paint color of the"Hardi-plank" siding shall be modified to a color better 12 approximating a natural cedar stain,to the satisfaction of staff. 13 14 d. The site plan shall be modified to show an expanded parking lot landscape island 15 (by the width of one parking space on each side of the island)directly north of 16 Tree#409. 17 18 3. Submit final engineered plans for the public improvements and storm water 19 management facilities,and an itemized cost estimate for review and approval by the 20 City Engineer. The final plans shall conform to the City's design standards and 21 specifications,and shall include the following supplementary materials, design 22 features, and notes: 23 24 a. All utility plans shall be based on the Lake Oswego vertical datum and shall 25 conform to the latest edition of the City's CAD standards and design 26 requirements. 27 28 b. A 2-foot wide public sidewalk easement on 8th Street to accommodate the 29 proposed sidewalk and landscape strip. 30 31 c. A sidewalk improvement plan for all street frontages, including an 8-foot wide 32 sidewalk on A Avenue, a 7-foot wide sidewalk on Bch Street,and a 5-foot wide 33 meandering pathway on Evergreen Road. The plan shall include the 34 reconstruction of the wheelchair ramp at the intersection of 8th Street and A 35 Avenue to comply with current ADA design standards. 36 37 d. A paving plan for the alley. If the row of small diameter pine trees near the south 38 end of the alley is removed,the alley shall be widened in that location to provide 39 at least 15 feet of pavement width. 40 41 e. An intersection improvement plan(A Avenue and 8th Street) including the 42 following features: 43 44 i. Reconfiguration of the northbound approach lane on 8th Street to produce a 45 Through/Left lane and a Right Only lane. This modification may require the 46 removal of d parking spaces on the east side of 8th Street. 47 48 ii. Signal head and detection loop modifications to reflect the lane 49 reconfiguration. 50 51 iii. Separate the detection loops on 8'h Street so that the north and south 52 approaches send independent indications to the traffic controller. LU 09-0029-1714 Page 6 of 13 1 2 iv. Install pedestrian countdown flashers on the A Avenue crosswalk. 3 4 (Note: The City will modify the traffic controller to be compatible with the above 5 improvements.) 6 7 f. Fire hydrants and FDCs shall be installed at locations acceptable to the Fire 8 Marshal. 9 10 g. Water services for the demolished dwellings shall be abandoned by removing the 11 corp stop from the main and plugging the main, 12 13 h. A final drainage plan. 14 15 i. Decorative street lights on A Avenue(Providence luminaires manufactured by 16 Architectural Area Lighting mounted on fluted Visco poles). Spacing shall 17 produce illumination levels specified in LOC Appendix 50.63.020-6. 18 19 j. All on and off-site lighting shall consist of high pressure sodium lamps. 20 21 k. Street tree locations shall be coordinated to provide at least ten feet of clearance 22 between light poles and tree trunks. 23 24 1. Supplemental directional signage and pavement markings as needed to ensure 25 drivers enter the south driveway on 8th Street during the drop-off and pick-up 26 times of day. Signage shall comply with the Sign Code and may be fixed or 27 removable at the applicant's discretion. 28 29 m. A construction traffic management plan. The plan shall specifically address the 30 issues of parking for construction workers,offsite staging areas if any,and road 31 closures and detours. 32 33 n. A final grading plan, showing bottom and top elevations for all retaining walls. 34 35 4. Apply for and obtain an encroachment permit to construct the proposed open space 36 and hardscape in the utility easement reserved in the vacated alley. If the permit is 37 denied,the applicant shall either modify the site plan to remove encroachments or 38 relocate the existing sewer line to the satisfaction of the City Engineer, Modification 39 of the site plan may require a modification of this Development Review(DR)permit 40 per LOC 50.86.025. 41 42 5. Construct all public improvements required by Condition B(3),above,or provide a 43 financial guarantee to ensure their completion per LOC 50.87.020. The financial 44 guarantee shall be 120%of the estimated cost of construction,based on a cost 45 estimate approved by the City Engineer. The applicant/owner shall submit 46 preliminary public improvement construction plans that are far enough advanced to 47 support an itemized estimate of the cost of construction. 48 49 6. Submit a final landscape plan that has been reviewed and approved by the consulting 50 certified arborist,to the satisfaction of staff. The landscape plan shall be the same or 51 substantially similar to Exhibit E9,with the following modifications and/or notes: 52 LU 09-0029-1714 Page 7 of 13 1 a. The landscape island directly north of Tree#409 shall'be expanded by the width of 2 one parking space on either side of the island. 3 4 b. All new irrigation systems(including any trenching to install the system)shall be 5 located outside of the dripline of existing evergreen trees within Evergreen Road 6 buffer area,to the satisfaction of staff. Any new irrigation heads shall have their 7 sprays directed away from the root zone of the evergreen trees, as possible. 8 Temporary inline drip irrigation shall be allowed within the dripline of the trees 9 but shall be removed after two years. 10 i 1 c. Illustrate plant species,size and spacing on the final plans. Trees shall be a 12 minimum of 2-inch caliper for deciduous and at least eight feet high if evergreen 13 (excluding the leader). All trees shall be planted with burlap or wire baskets 14 completely.removed, 15 16 d. All shrubs shall be a minimum of three gallons or 24 to 36-inches in height, 17 whichever is greater. 18 19 e. All mitigation and street trees shall have burlap and wire baskets removed prior to 20 planting,to the satisfaction of staff. 21 22 1. Submit a detailed landscape maintenance plan. 23 24 7. Apply for and obtain a verification tree removal permit. The applicant shall obtain 25 approval from the City Manager for the two trees located in the public right-of-way 26 (Trees# 596 and 597). The verification tree removal permit submittal shall include 27 an 81/2"x 11"copy of the tree removal plan(Exhibit E4), and a mitigation plan 28 showing replacement trees on a minimum 1:1 basis. Replacement trees shall not be 29 dwarf or ornamental varieties and shall be at least two inches in caliper,if deciduous 30 or at least 6-8 feet tall(excluding the leader)if evergreens. Street trees shall not be 31 credited towards mitigation planting requirements. All mitigation and street trees 32 shall have burlap and wire baskets removed prior to planting,to the satisfaction of 33 staff. 34 35 8. Submit a tree protection permit application as required by LOC 55.08.020 and 36 55.08.030 for review and approval by staff, including off-site trees that are within the 37 construction zone. The tree protection plan shall be prepared in accordance with the 38 preliminary protection plans in Exhibits F7 and F8, and as approved by staff to 39 manage initial construction activities within the dripline of existing trees. The tree 40 protection plan shall provide specific details for Trees# 198,216,217,218, 219, and 41 409,with all therapeutic measures specified(including minimizing fill and providing 42 aeration within the dripline of trees),to the satisfaction of staff. This plan shall be 43 attached to the construction documents or printed on the construction site plans,and 44 shall include: 45 46 a. The location of temporary tree protection fencing,consisting of a minimum 6-foot 47 high cyclone fence secured by steel posts,around the tree protection zone,or as 48 recommended by the project arborist and approved by the City. 49 50 b. A note stating that no fill or compaction shall occur within the critical root zones 51 of any of the trees,or that if fill or compaction is unavoidable, measures will be LU 09-0029-1714 Page 8 of 13 1 taken as recommended by a certified arborist to reduce or mitigate the impact of 2 the fill or compaction. Such measures should be clearly outlined in the tree 3 protection plan. The note shall also inform contractors that the project arborist 4 shall be on site and oversee all construction activities within the tree protection 5 zone. 6 7 c. A note that clearly informs all site contractors about the necessity of preventing 8 damage to the trees, including bark and root zone. The applicant and 9 contractor(s) shall be subject to fines,penalties and mitigation for trees that are 10 damaged or destroyed during construction. 11 12 d. A sign shall be attached to the tree protection fencing,which states that inside the 13 fencing is a tree protection zone,not to be disturbed unless prior approval has 14 been obtained from the City Manager and project arborist. 15 16 9. Provide a written agreement between the applicant and a certified arborist 17 demonstrating that the arborist will review the final demolition,site,utility, grading 18 and Iandscape plans to assure long term survival of all trees to remain,and will be 19 present on site at any time during excavation,trenching,grading,root pruning or 20 other activity occurring within the tree protection zone to ensure proper protection of 21 trees. The arborist report shall outline protection measures that will maintain a 22 favorable root environment for preservation of these trees. 23 24 10. Submit a copy of the geotechnical report with the building permit(Exhibit F10). The 25 final building design shall incorporate all recommendations of the geotechnical 26 engineer. The consulting geotechnical engineer shall be present on site to certify that 27 soil conditions are suitable prior to the placement of concrete footings or pavement 28 base rock. 29 30 11. Submit a revised Circulation Plan showing ingress to the site during student drop- 31 off/pick-up restricted to the southerly driveway entrance on 8''Street. 32 33 12. Submit a"Notice of Development Restriction"containing the following restrictions, 34 which must be recorded against the site, for review and approval of staff. A reduced 35 copy of the revised Circulation Plan(Exhibit E 19 of this report)shall be included in 36 the Notice of Development Restriction and labeled as"Exhibit A"to be recorded in 37 the County record. A reduced copy of the site plan (Exhibit E5)shall also be 38 included in the Notice and labeled as"Exhibit B"to be recorded in the County record. 39 The exhibits shall be no larger than 8 '/2"x 11" in size and cannot contain any 40 lettering smaller than 10 point font. The development restriction shall include the 41 following information: 42 43 a. The K-8 grade school shall be restricted to a maximum of 320 students. Any 44 modifications to the range of grades provided by the school and/or number of 45 students enrolled at the school beyond 320 shall require a modification to the 46 Conditional Use approval. 47 48 b. Daily student pick-up and drop-off for the K-8 school shall be controlled by the 49 approved Circulation Plan. See attached Exhibit A. 50 51 c. Uniform Exchange Station a. There will be some uniform pieces that are in good condition available b. These items are free of charge, so please feel free to look over the selections and take what you believe your child(ren) could use. An extra pair of slacks, shorts or polo shirts is always good to have on hand. This is an excellent idea for K and l'` graders who need to have the extra uniform left at school. UNIFORM CLARIFICATION The faculty and I are committed to enforcing the uniform policy of the school. It is the parent's responsibility to check your child's adherence to the uniform code before leaving the house in the morning. A couple of frequent violation areas are: 1. Girls' skirts can be no more than 4 inches above the knee when they are kneeling, 2. Socks—both boys and girls—must be above the ankle and visible—if your child is wearing high top shoes or boots,the sock must be above the top and visible. a. The new OLL sock option seems to be a very popular addition to the uniform. The sock must be the OLL sock. 3. Shoes—predominantly means that most of the shoe is black,brown, blue(prefer dark blue)or white closed toe with low rubber sole and heel. a. Examples of non-uniform shoe choices include, but not Iimited to checkered shoes, Vans with hearts,turquoise(or other variations of blue)and sparkles. 4. Boots—we limit the style of boot. Black or brown smooth leather may be worn providing the heel is no more than 2 inches in height. The heel height is a safety issue on the playground and stairs. We do not allow UGGS. knee high tennis shoes, cowboy or suede boots. 5. Lands' End Orders—if you order from Lands' End,please remember to include the school name in the appropriate order form blank. This will insure compliance with our uniform code. CALLED TO PROTECT TRAINING The sessions for the initial training are: o Thursday,August 141h—1:00 p.m.—Cana Room o Tuesday, August 196—5:00 p.m.—Cana Room o Tuesday, September 2"d—1:00 p.m.—Cana Room (change of time& location) o Wednesday,September 10`h—1:00 p.m.—Cana room This is the required video training for all adults working as a volunteer with children. If you are a new parent, or a returning parent that has not participated in the Called to Protect training, and wish to volunteer, you must register and attend one of these sessions. Most of our current parents have fulfilled this video training. However,there is the yearly on- line training which all previously cleared volunteers must watch. This year's requirement is entitled: The Ditty to Report. Families current during the 2013-2014 school year: 1. Your background check clearance will be good until April, 2015 regardless if it expires prior to that date. 2. On-line course, The Duty to Report, required by August 30, 2014. Please print out a copy of the certificate to bring to Registration on September 2,2014. Families new to the school: 1. The procedure for you to complete your background check is forthcoming from the Archdiocese. As soon as I know you will be notified. The Archdiocese has contracted with a new background check company which has passed the highest scrutiny for confidentiality and security. 2. The on-campus video course"Called to Protect"is required. If you haven't already, please call the school and register for one of the sessions listed above. The session's last about 1 'A hours. These are adult only trainings. In earlier correspondence it has been clear that without a current Background Check, participation in either the video training or the on-line training for previously certified volunteers, by September 2nd, you will not be allowed to volunteer in the school until January, 2015 when we run these sessions again. For new families to the school, the video training and background check clearance (we will let you know the process as soon as we do)have until September 26th,2014 to complete the requirement and then we will add you to the approved volunteer list. HOT LUNCH The Hot Lunch option, offered through the "My Lunchbox" vendor, will again be available beginning October 1st. In mid- September, you will receive a lunch order form. "My Lunchbox"menus will be available on Monday,Tuesday,Thursday and Friday. If your child will be participating you will need to complete the form, and return with payment. Wednesday's are used for fundraising lunches, e.g. helping offset cost of Outdoor School, etc., The school(versus the vendor) manage these lunches. During September and October, Wednesday Hot Lunches will be available to help with various school activities. The menu is included in this envelope. ENDOWMENT NEWS The OLL Endowment Fund will again be contributing a wonderful sum (close to $70,000) to this year's budget which helps offset tuition assistance. Every year parents are given the opportunity to add to this fund through a tax deductible donation. There are additional fundraising vehicles the Endowment Advisory Board uses each year to add to the principle of the fund. Stay tuned to this year's event! OLL is a terrific institution to support! Traffic Safety • The traffic patterns are designed for the safety of the children • Please drive slowly at all times • NO use of cell phones when car is moving Drop-Off Procedure • Please enter the parking lot from the Eighth Street driveway closest to Evergreen Road. • Cars should pull forward to the handi-cap parking slot nearest the church. Do not leave any gaps between you and the car in front of you. Maintain a continuous line. We cannot allow cars to congest on 8th Street waiting to enter the parking lot. School personnel will direct you. • Cars can unload from that handi-cap parking slot,down the line to the play structure area. • Children should be ready to exit the car when it stops. That is, they should have in hand their book bag, lunch,etc. Messages to them should have occurred before the car door opens. • ChiIdren should exit from the passenger side for safety. • Cars that have parked and wanting to exit need to wait for a safe opportunity. Do not stop your car to let the other car out. • If the adult is coming into the school with the child, you must park in the middle section of the parking lot. Staff members will assist you in crossing the car line. SCHOOL FORMS In this packet I have included an "Authorization for Medication Administration by School Personnel" form. This form must be completed for any student requiring regularly administered medicine during a school day. Please carefully read the form and when school begins return to the school office with the medication. As a reminder,all other school forms that Mrs. Allori and Mrs. Young have forwarded to you over the summer are due now! SCHOOL PICTURES This year we have contracted with Life Touch photographers to take our school pictures which will take place on Thursday, September 18`h YEARBOOK 1. The 2013-2014 yearbook will be ready for pick-up at Registration on September 2nd 2. The 2014-2015 yearbook advisor this year will be Mr. Alex Ferguson,Art teacher,who Will work with 8th grade photography students to collect pictures during the year for the publication. The students will be able to gain not only photography experiences, but layout design and numerous other journalistic skills. We are thrilled Mr. Ferguson has agreed to direct this project. 3. The yearbook will also be published by Life Touch. This will allow us to have a local representative available for consultation, etc. 4. On behalf of the whole Our Lady of the Lake Catholic School community I want to thank Mr. and Mrs. Valderrama for the endless hours they have spent over the last few years taking pictures and directing the publishing of this memory book. SCIENCE STUDENTS—Grades 6, 7,8 As an FYI to parents, students who have science or math questions for Mr. Willingham in the morning will have a small change in procedure. They will enter by the Extended Care room door as usual. Mr. Willingham will be available between 7:30 and 7:50 for questions, explanations, etc. Once the students' question has been answered,they will be asked to return to the Extended Care room where they may study or may join the other students in morning care activities. Once they enter the school with the intention of speaking with Mr. Willingham,they will be "signed into" Extended Care,then dismissed to ask their questions with the expectation they will return to the E.C.room. They will not be allowed to stay in the Science lab as their morning care/study option. Thank you for your understanding in this procedural change. FIRST GRADE CHANGE During the early summer,Mrs. Mullen resigned her teaching post at OLL. We interviewed a number of qualified candidates and have hired MRS.WENDY MACKIN as our new first grade teacher. She and her family have recently moved here from Denver, Colorado, where she was very active in the Denver community as well as in her faith community in addition to her teaching responsibilities. She was educated at Regis College in Denver and her professional teaching experience in the primary grades was in the Denver area as well. One step in this process sought input regarding the transportation impact from the neighbors. This resulted in the City of Lake Oswego requiring periodic traffic reviews. The initial review occurred during this first year in the new facility, and with subsequent reviews to occur for several years to come. Following each year's traffic study, a neighborhood meeting will be held and the results brought before the City of Lake Oswego Development Review Commission(DRC). The findings of the first review indicated a significant increase in school traffic on Evergreen Road (over the 2010 base count). The morning increase charted at 65% and the afternoon increase at 57%. The DRC allows an increase of no more than 20%. This increase appears to be a result of vehicles using Evergreen Road to bypass the traffic light on the A Ave. and 3`h Street intersection. The Evergreen Road usage was observed during the traffic study and was also observed by neighbors to the south in the Evergreen Neighborhood. The neighbors acknowledge that while mornings can be rushed, many parent drivers are unreasonably hurried when driving along Evergreen to save time. This has raised a safety, as well as livability issue among the neighbors affected by the increased school traffic. When the DRC considered the Evergreen neighborhood traffic impact, they discussed a number of actions to ensure the development conditions of approval are met by Our Lady of the Lake Parish/School. The DRC actions could be as simple as this letter communicating the neighborhood concerns along with a request to not use Evergreen, or more serious enforcement actions, such as capping the OLL School enrollment. Both of these options, as well as others,have been considered by the DRC. The new OLL parish facility, including the school, was constructed for a number of reasons. Not only did the former building not meet code, but it was inadequate to accommodate 21s1 Century educational expectations. During all of the planning, construction, and now the occupancy phase, Our Lady of the Lake has always intended to be good neighbors and honor our commitment to the City of Lake Oswego. Therefore, please DO NOT use Evergreen Road for student drop-off before school or pick-up after school. Instead, please DO USE A Ave. to 8th Street for entering and exiting the school/parish campus. Observance of the travel behavior will not only address neighborhood concerns, it will increase safety for pedestrians and bicyclists using Evergreen Road. Furthermore,this travel behavior will help to prevent other measures from being enforced, such as enrollment caps or road closures. Just an FYI to help us all remain sane ( or for me somewhat sane) during morning and afternoon canine. One of the requirements from the City of Lake Oswego is that we not block 8th Ave under any circumstances. So in the event that you arrive at school particularly in the afternoon and you cannot get into the lot, please drive around the block and try again. Also, Evergreen Street is sort of off limits unless you live on it or have to come that way. We have maintained a very good relationship with our neighbors on that street by pretty much eliminating school traffic, and we arc doing our best to keep it that way. I can hear you saying, "well if I have to drive around the block" and I understand that once in a while you may have to, but generally speaking no regular traffic on Evergreen. So far so good, I know we can count on you. In the morning when you drop off your child please pull forward all the way to the Parish Mall before stopping, that way we can unload many more cars at one time. In the afternoon, if you haven't figured it out already, coming way early is not necessarily an advantage. If you come at 3: 10 pm you will wait hardly any time at all. To my "old" families, maybe you could let our- "newbies" come a little early until they get used to our system. To our new families, it would help us tremendously if you could put the name plates we gave you on the driver's side of the dashboard. I believe the last two weeks of September there are only sandwiches on the selection menu. Beginning the first of October,hot lunch options will also be available. If you haven't already reviewed the My Lunch Box flyer, there is another included in the parent pack envelope that came home with your child today. If you have questions about this service,please call Eve or Mike(their telephone numbers are listed on the flyer. Each Wednesday of the month, a hot lunch option will be offered,and that information will come home in the middle of the month preceding from Mrs. Allori. These Wednesday lunches are fundraisers to offset the cost of school activities,e.g. 5`h grade OMSI Science Camp,6th grade Outdoor School,etc. PARISH FESTIVAL Please consider joining the fun at the parish festival this coming Saturday, February 13`h! While there is a flyer enclosed in your parent pack envelope today and it has been on the parish website for awhile, I thought maybe reminding you that— I. School families eat free and receive 1 fun ticket free(your Parent Association dues pays for this part of the event) 2. From 11 a.m. to 3 p.m. —there will be a live band -Ants in the Kitchen— At some point both Fr. John and Fr. Charles will be performing with them. 3. More fun tickets will be available for purchase at the event for activities like the inflatables 4. Please re-read them and if you have questions please call me. DROP-OFF AND PICK-UP PROCEDURES Drop-Off/Pick-up of Students—Please,be a good neighbor and DO NOT use Evergreen Road coming to,or going from School. For new families there is an additional letter included in your parent pack with an explanation.The city will be doing another traffic survey soon and it would be well if we were in total compliance. Traffic Safety • The traffic patterns are designed for the safety of the children a Please drive slowly at all times • Please do not be on your cell phone when cars are movine._The safety of every child is paramount. Drop-Off Procedure • Please enter the parking lot from the Eighth Street driveway closest to Evergreen Road. • Cars should pull forward to the handi-cap parking slot nearest the church. For a few days I will put a stop sign at the point you should pull forward to.Do not leave any gaps between you and the car in front of you. Maintain a continuous line. We cannot allow cars to congest on 8th Street waiting to enter the parking lot. School personnel will direct you. • Cars can unload from that handi-cap parking slot, down the line to the play structure area. • Children should be ready to exit the car when it stops. That is, they should have in hand their book bag, lunch, etc. Messages to them should have occurred before the car door opens. • Children should exit from the passenger side for safety. • Cars that have parked and wanting to exit need to wait for a safe opportunity. Do not stop your car to let the other car out or stops for folks who have parked in the middle section and want to walk in the school. • Since we are in the second week of school, we ask that all parents use the carline for drop off and, unless you have a pre-arranged appointment in the building, let your child walk in with all the other students. There is ample supervision so no need to worry they won't find the classroom. Pick-up Procedure • As with morning drop-off, enter the parking lot from the driveway closest to Evergreen Road • If you come early and park,please turn off your engine until your line is ready to go. It not only will save your gas, but will be much kinder to the environment. • A staff member will direct you to an area to "line-up". Please null in close to the car next to and in front of you (we need to place as many cars as possible in the holdin,+i pattern). - --- -- --- ,..____ • If parked correctly,we should have 5 lines in the is'bay,6 in the 2nd;the 3rd bay is variable due to the possibility of visitor cars parked along the wall. Right now there is usually too much space between cars in the 151 bay. Again our goal (besides being safe) is to keep cars from backing up on 8eh which would riot make the neighbors or the city happy! • When the car line begins please follow the staff member's direction. If you are a new family please display your name card as you approach the staff person with the bull-horn. If you can hold up your sign facing the teacher with the bull-horn it would be helpful. She cannot read it when it's on the passenger side of the dash-board. • As you exit, please turn right onto 8th Street (unless you live in the Evergreen Neighborhood). • If a driver, unfamiliar with the system, is to pick up your child: o Make sure their name is on your approved list for pick-up or call the office to give that permission o Explain to them the system used o Let your child know, if possible that someone other than you is picking them up • Grades K-6 will exit from the front doors of the Parish Center. Seventh & eighth grade students will exit from a side door. Only those who live within walking distance from the school,and have a current parent note on file with the school office, will be allowed to proceed toward A Avenue and walk home. These students should be reminded to use the signalized crosswalk. • Please note: Children waiting in the carline will only be released to the car picking them up. Parents may not walk into the carline to retrieve children!!_ This is a safety issue. • At all times,please follow the directives of staff on duty STUDENT ACCIDENT INSURANCE In today's envelope there is information about the Accident & Sickness Insurance Program Student Coverage that the Archdiocese carries on every student. Please review the information. The last traffic study continues to show that the OLL traffic flow plans and the communications with parents has definitely paid off. We want to thank OLL for their ongoing cooperation with our neighborhood. We do appreciate it; we congratulate them, not just on successful traffic management, but on the beautiful new school.
